RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-200-89 be received;
2. THAT the rezoning application submitted by Markborough Properties and West
Bowmanville Developments for a 2.5 ha parcel in Part Lots 15 and 16, Concession
1, former Township of Darlington, be referred back to Staff for further
processing and preparation of a subsequent report; and
3. THAT the applicant, all delegations and persons listed to be notified be advised
of Council's decision.
1. BACKGROUND:
1.1 Tunney Planning has submitted a rezoning and site plan application on behalf
of Markborough Properties and West Bowmanville Developments for a 2.5 ha
parcel in Part Lots 15/16, Concession 1, former Township of Darlington. The
application proposes the development of approximately 4230 sq.m. of retail
commercial floorspace and approximately 900 sq.m. of motor vehicle repair
garage and fuel bar uses (see Attachment No. 1) .

1.2 The subject lands are located within the Bowmanville Major Urban Area,
and are designated "Residential" in the Durham Regional Official Plan.
The Town's Official Plan indicates a "Local Central Area" in the vicinity
of the subject property. Local Central Areas are permitted up to 5600 m2
of retail and personal service floorspace.
1.3 The northern portion of the subject lands are zoned "General Commercial -
Holding ((H)C1)", while the southern portion is zoned "Agricultural (A)".
The commercial zoning was established through Rezoning Application DEV
88-11, previously submitted by West Bowmanville Developments, to
implement the "Local Central Area" designation. This application in
effect would alter the boundary of the land zoned "H-Cl" to allow the
proposed uses.
2. PUBLIC NOTIFICATION:
2.1 In accordance with departmental procedure, notice of the application and
the Public Meeting was posted on the property and mailed to all property
owners within 120m. Notice was also mailed to those parties expressing
an interest in the application.
3. CIRCULATION COMMENTS:
3.1 The subject application has been circulated to relevant departments and
agencies for comment. However, as of the writing of this report, no
circulation comments had been received by Staff.
4. PUBLIC SUBMISSIONS:
4.1 No public submissions have been received to date on the subject
application.

5. OTHER COMMERCIAL APPLICATIONS:

5.1 Markborough Properties and West Bowmanville Developments Ltd. have also
submitted a revised Official Plan Amendment application (File:
88-87/D/N) to designate a 23.0 ha parcel south of Highway No. 2 as a
Sub-Central Area to permit a range of commercial, institutional,
community, recreational, and residential uses as provided for by the
Durham Regional Official Plan (see Attachment No. 2) . The rezoning
Application (File DEV 88-99) proposes to develop a 21,400 sq.m. shopping
centre on a 10.2 ha portion of the proposed Sub-Central Area. The Public
Meeting for these applications is scheduled for September 18, 1989.
This application, if approved, will be considered as part of the
sub-central area designation sought by the applicant.
5.2 For the information of the Committee, Attachment No. 2, indicates number
of other commercial proposals fronting on Highway No. 2 which are
currently being processed by Staff as follows:
- Delbert Development Corporation is proposing to include a 2.5 ha
parcel within the proposed Sub Central Area in order to develop 8500
sq. m of retail commercial and personal service floor space.
- Willsonia Properties is proposing to include a 4 ha parcel within the
Bowmanville Urban Area in order to develop 11,800 sq. m of Special
Purpose Commercial floorspace.
- Carnovale Construction Ltd. is proposing to designate a 'Local Central
Area' with 2230 sq. m of retail commercial and office space.

6. STAFF COMMENTS:
6.1 As noted earlier, a portion of the site is zoned "Holding - General
Commercial ( (H)Cl)" as a result of a previous application by West
Bowmanville Developments to utilize the "Local Central Area" designation.
The current application seeks to redefine the limits of the Local Central
Area.
6.2 The Town of Newcastle Official Plan (Section 7.2.5.2 ii) states that a
Local Central Area is intended to serve as a focal point of activity for
residential communities serving the day to day needs of the residents of
the surrounding residential areas.
The commercial development presently being proposed involves a single
user. The major component is retail commercial with associated motor
vehicle repair service and fuel bar uses.
6.3 As previously noted, Markborough Properties and West Bowmanville
Developments are proposing to include the subject commercial development
as part of the SubCentral Area being proposed by Official Plan Amendment
application 88-87/D/N. They have also indicated their intention to
submit a revised market analysis for the proposed Sub-Central Area which
would reflect the subject commercial development, as well as the 21,400
sq.m. of retail commercial and personal service floorspace being proposed
immediately west of the subject site.
7. CONCLUSIONS AND RECOMMENDATIONS:
7.1 The subject commercial development proposes to redefine the Local Central
Area designation as currently set out by the Comprehensive zoning By-law.
Comments from circulation of the rezoning application and the related
site plan application have not been reviewed. It is therefore
recommended that Rezoning Application DEV 89-93 be referred back to Staff
for further processing and the preparation of a subsequent report upon
the receipt of all circulation comments.
