HOFSTEDE
RECOPtMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-26-87 be received for information.
BACKGROUND AND COMMENT:
An application had been filed by Mr. Hofstede for a rezoning of Part of Lot 17, Concession
1, former Township of Darlington to permit the development of one (1) additional
residential lot. This application was dealt with by Council on October 14, 1986 and was
denied without prejudice. At the Council meeting of November 10, 1986, Council reversed
its decision and approved the application. Resolution #C-941-86 stated that:
"NOW THEREFORE BE IT RESOLVED
has been submitted, that the

entered into with the Town of

THAT because of the additional information which

It was upon this resolution that By-law 86-144 was approved.
On December 12, 1986 the Clerk's Department received an appeal from the
Region of Durham. The appeal was filed due to non-conformity to the
Regional Official Plan, but is to be subject to a further report by
Regional Planning Staff.
Town Staff had recommended that the application be denied based upon
non-conformity with the Official Plan and the fact that the intent was
not substantially different from a 1985 application which was denied.
Reasons were detailed in Staff Report PD-228-86.
Since Staff concur with the Region's reasons for the appeal, Staff would
not be able to defend this By-law before the Ontario Municipal Board.
The options available to Council are repeal of By-law 86-144, or
submission of the By-law to the Ontario Municipal Board for a hearing.
Pending the Region's further consideration of this matter, as noted
above, it would seem appropriate to take no action at this time.
