THAT Report PD-27-87 be received; and 2. THAT the application submitted by Mr. K. Simard to rezone a 0.21 hectare parcel of land located in Part Lot 34, Concession 2, former Township of Darlington to permit a Nlotor Vehicle Sales establishment be approved; and 3. THAT the By-law attached hereto be forwarded to Council for approval at such time as Staff have received confirmation that the lands have been melded with the adjacent property to the west and the existing Site Plan Agreement has been amended to add the subject property. BACKGROUND AND COMMENT: Un November 17, 1986 the Planning Department received an application submitted by Mr. Ken Simard on behalf of Ontario Pony to rezone a 0.21 hectare (0.52 acre) parcel of land in Part of Lot 34, Concession 2, former Township of Darlington (see attached map). The purpose of the rezoning would be to permit the development of a Nlotor Vehicle Sales establishment. ...2 j~r~) REPORT NU.: PD-27-87 Page 2 The Regional Planning Department has reviewed the application and has provided verbal comments. The subject lands are considered to be the boundary of the "Special Purpose Commercial" designation and considering the circumstances, their inclusion can be considered as consolidation and not promoting strip development. l~he subject lands are located on the south side of Highway No. 2, east of Darlington Boulevard. The Official Plan of the Darlington Planning Area and the Neighbourhood Development Plan for the Courtice West Neighbourhood both show the site as approximating the edge of the Special Purpose Commercial area. The boundaries shown are general in nature and in cases where there are no clearly identifiable boundaries, the boundaries shall be defined by the Zoning By-laws (Section 6.11.4). When this site is located on the Schedules, the demarcation line between the "Residential " and "Special Purpose Commerci al" designation runs approximately down the centre of the property. The intent of the applicant is to meld the subject lands with those which he owns immediately to the west and south, and develop the entire parcel. The other parcels are clearly within the "Commercial" designation. It seems appropriate that Staff should encourage the consolidation of such lands in order to provide for viable development along our "Special Purpose" corridors. Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In accordance with departmental procedures, the application was circulated to obtai n comments from other departments and agencies as noted i n Staff Report PD-295-86. In commenting on the above-noted application, Staff would note the following departments/agencies offered no objections to the proposal: ...3 ~c~, REPURI~ NU.: PD-27-87 Page 3 - Newcastle Public Works Department - Newcastle Community Services Department - Newcastle Fire Department - Newcastle Building Department - Central Lake Ontario Conservation Authority - Regional Health Services Department - Ministry of Natural Resources - Untario Hydro - Bell Canada Regional Works Department has provided verbal comments to Staff. Full municipal services are available through the newly constructed services on Highway No. 2. There does not appear to be any adverse impact on abutting services if the Motor Vehicle Sales establishment is created. The Works Department will have to approve the Site Servicing Plan prior to any development and the Regional frnotage and connection charges will be applied. The subject lands are to be melded with the property to the west, known as the "Moase" property. There is currently a Site Plan Agreement for this property and this will be updated to add the new lands and, Staff shall, at that time, review the entire site to ensure that the optimal design is chosen for the site. * The By-law attached to this Report will rezone the lands to permit the development of the site for "Special Purpose Commercial" uses. After reviewing the situation, it seems more appropriate to use this site commercially than to continue the residential use in such an uncompatible atmosphere. The development of the lot for a Motor Vehicle Sales establishment is more in keeping with the intent of the Official Plan. Also, the consolidation of properties is considered to be of benefit when redeveloping land. This also provides an oppo rtunity to rationalize some of the accesses onto Highway No. 2. Such changes can assist in attaining the goals of the Type 'A' Arterial (limited access) road. ...4 f,/ Cn) REPORT NO.: PD-27-87 Page 4 Staff is in support of this application and are of the opinion that this amendment to the Zoning By-law is appropriate for the redevelopment of this * site. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One ((H)R1)" to "Special Purpose Commercial (C5 )" zone as shown on the attached Schedule "X" hereto. 2. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
