RECD ENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-28-86 be received; and
2. THAT the application submitted by Mr. D. Ewart on behalf of Dondeb
Construction to rezone a 1.23 hectare parcel of land located in Part Lot 10,
Concession 1, former Town of Bowmanville to amend the setback and unit count
requirements of By-law 84-63 in respect of an approved 117 unit apartment
building on municipal services be approved; and
* 3. THAT the By-law attached hereto be forwarded to Council for approval.
BACKGROUND AND COMMENT:
Un November 'L6, 1986 the Planning Department received an application submitted by
Mr. D. Ewart on behalf of Dondeb Construction to amend By-law 84-63 in respect of a
1.23 hectare (3.U5 acre) parcel of land in Part Lot 10, Concession 1, former Town of
* Bowmanville (see attached map). The purpose of the rezoning would be to permit a
reduction in building setback and an increase in the number of units to One Hundred
and Twenty-one (121) . At thi s time, a 117 unit apartment bui 1 di ng i s permi tted by
the By-law. The site is zoned as "Urban Residential Exception Type Four (R4-4 )" and
"Environmental Protection (EP)".

In comments from the Regional Planning Department, Staff was advised that:
In response to your request for comments, the subject site is designated
"Residential" in the Durham Regional Official Plan. This designation is
designed to accommodate a variety of housing types.
The subject site appears to be designated "Residentia1" and "Major Open Space"
in the Bowmanville Urban Area Plan with a "High Density Residential Area"
symbol in the vicinity of the site. Residential uses in the density range of
55 to 80 units per net residential hectare are permitted.
Proposals for residential uses i n excess of 80 units per net residential
hectare are subject to the considerations of Section 2.1.2(iv)(c).
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate si gnage acknowl edgi ng the application was i nstal 1 ed on the subj ect
lands. Staff would note that no objections to the proposal were received at
the writing of this Report with respect to the amendment requested.
In accordance with departmental procedures, the application was circulated to
obtain comments from other departments and agencies as noted within St aff
Report PD-296-86. Staff would note that no objections have been received to
date and the applicant has been in touch with each of the agencies who were
circulated.
Central Lake Ontario Conservation Authority has submitted written comments and
have provided no objection to the proposal. Their conditions will be
incorporated into the revised Site Plan which Staff is now finalizing.
In view of the fact that these are only minor revisions to a Special By-law
passed in 1982 and considering that verbal comments have resulted in no
objections to the principle of the rezoning.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NUW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 15.4.4(a) is hereby amended by changed from "Dwelling
Units (maximum) 117" to "Dwelling Units (maximum) 121".
2. Section 15.4.4(d)(iii) is hereby amended by changing from
"Exterior Sideyard 50 metres" to "Exterior Side Yard 8 metres".
3. Section 15.4.4(h) is hereby amended by changing from "1 having
a minimum area of 35 metres" to "1 having a minimum area of 35 square
metres".
4. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
