It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-202-87 be received for information.
BACKGRUUIVD ANU CUhiMENT:
For the information of the General Purpose and Administration Committee, Staff have
prepared the attached list of applications to the Committee of Adjustment for the meeting
of July 9, 1987. This list includes the file number, applicants name, site location, type
of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments on
'the applications and the Committee of Adjustment's decision.

APPLICATIONS:
A 47/87 - Dianne Killick, Lot 14, Concession 8, Darlington.
Application was made for. relief from zoning by-law requirements in
order to permit the applicant to construct a 900 sq. ft. accessory
building which would exceed the maximum requirement of not more than
40% of the main building total floor area.
Ms. Killick and Mr. 6Jilliams appeared in support of this application.
No other person appeared in support of or in opposition to this
application.
Moved by Mr. Barrie, seconded by Mr. Heming,
"THAT as the requested variance would not appear to
have an adverse effect on the surrounding property
and would not appear to offend the intent of the
Official Plan or Zoning By-law, permission is GRANTED
to construct a 900 sq. ft. accessory building."

A 48/87 - Halminen Homes Limited, Lot 9, Conc. 1, Bowmanville (Lot 12, 1OM782)
Application was made for relief from zoning by-law requirements in order
to permit the applicant to construct a single family dwelling leaving
a rear yard of 3.12 m, instead of the required 7.5 m rear yard.
No person appeared in support of or in opposition to this application.
Pioved by Mr. Herring, seconded by Mr. Murdoch,
"THAT as the requested variance does not appear to
offend the intent of the Official Plan or Zoning By-
law, and, due to the triangular shape of the property
at the rear, would appear to be minor in nature,
permission is GRANTED to construct a single family
dwelling .leaving a rear yard of 3.12 m."
'Payne & Barrie opposed' "CARRIED"
A 49/87 - Greg & Susan French, Lot 15, Conc. 7, Clarke.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to the existing
single family dwelling leaving a 7.0 m rear yard, instead of the
required 10 m rear yard.
Mr. and Mrs. French appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mrs. Payne,
"THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-
law and, due irQ the location, would not appear to
have a detrimental effect on the surrounding neigh-
bourhood, this variance is considered to be minor in
nature and permission is GRANTED to construct an
addition to the existing single family dwelling,
leaving a 7.0 m rear yard."

Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot with an existing single family
dwelling having a rear yard of 4.5 feet (1.37 m), instead of the required
7.5 m rear yard.
Ivan Novak and John Novak appeared in support of this application. No
other person appeared in support of or in opposition to this application.
Moved try Mr. Murdoch, seconded by Mr. Rehder,
"THAT as the proposed variance would appear to conform
with the intent of the Zoning By-law and the Official
Plan and as the shortage in the rear yard should not
have a detrimental effect on the area, permission is
GRANTED to create a lot with an existing single family
dwelling having a rear yard of 4.5 feet (1.37 m),
instead of the required 7.5 m rear yard."

Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot and continue the use of a
second single family dwelling on same lot having a rear yard of 2.3 m.
Mark Foley appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Barrie,
"THAT as the situation of the one lot with two single
family dwellings on it has been in existence for many
years, permission is GRANTED to continue this use
until such time as sewer and water facilities are
available on Townline Road South. At that time the
dwelling at the rear is to be demolished. Also
permission is GRANTED to continue the use of this lot
with the two single family dwellings with the dwelling
at the rear having a rear yard of 2.3 m."

A 52/87 - Marjorie Huxter, Lot 12, Concession 2, Bowmanville.
Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot with a frontage of 40 ft. (12.1 m),
instead of the required 15 m frontage and to permit the continued use
of an accessory building with a 0 side yard, prior to the construction
of the main residential use. (69 Scugog St.)
Mr. & Mrs. Huxter appeared in support of this application. Ken Park
and Dan Delong appeared in opposition to this application. A letter
of objection was received from Jim and Dorothy Thompson. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mrs. Payne,
"THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-
law and is considered minor in nature, permission is
GRANTED to create a lot with a frontage of 12.1 m.
This variance is conditional upon the removal of the
existing accessory building."

Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot with a frontage of 47.67 feet
(14.5 m), with an existing legal non-conforming triplex having side yards
of 10.12 feet and 4.9 feet with a porch encroaching further into that
yard. (69 Scugog St.)
Mr. & Mrs. Huxter appeared in support of this application. Ken Park
and Dan Delong appeared in opposition to this application. A letter
of objection was received from Jim and Dorothy Thompson. No ot{~er
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mrs. Payne,
"THAT as the proposed variance would appear to conform
with the intent of the Official Plan and the Zoning By-
law and as the variance in the frontage is considered
to be minor in nature, permission is GRANTED to create
a lot with a frontage of 47.67 feet (14.5 m) with an
existing legal non-conforming triplex having side yards
of 10.12 feet and 4.9 feet with a porch encroaching
further into that yard. This approval is conditional
on suitable parking facilities being provided at the
rear of the lot."

Dan Lymer appeared in support of this application. No other person
appeared in support of or in opposition to this application.

"THAT as the requested variance appears to conform
with the intent of the Zoning By-law and Official Plan
and is considered minor in nature, permission is GRANTED
to continue the construction of a single family dwelling,
leaving a side yard of 1.16 m."

Application was made for relief from zoning by-law requirements in

instead of the required 6.00 m exterior side yard.
Dan Lymer appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Rehder, seconded by Mr. Barrie,
"THAT as the requested variance appears to conform
with the intent of the Zoning By-law and the Official
Plan and is considered minor in nature, permission is
GRANTED to continue the construction of a single family
dwelling leaving an exterior side yard of 5.00 m".

"THAT as the requested variance appears to conform with
the intent of the Zoning By-law and Official Plan and
is considered minor in nature, permission is GRANTED to
the applicant to continue the construction of a single
family dwelling leaving a front yard of 5.91 m."

Appeal date for the foregoing applications is August 8, 1987.
