RECOMh1ENDATIONS:
t~t ~s respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-206-87 be received; and
2. THAT the Region of Durham be advised that the Town of Newcastle recommends that
Official Plan Amendment Application 87-9/D submitted by Ronald Shoobridge be denied;
and
3. THAT a copy of Council's decision be forwarded to the Region of Durham, the
applicant and the interested parties indicated hereto.
BACKGROUND:
On March 6, 1987, the Town was advised by the Region of Durham of an application submitted
by Nir. Roanld Shoobridge to amend the Durham Regional Official Plan to permit the creation
of one (1) additional residential lot in Part Lot 34, Concession 1, former Township of
Clarke (see Key flap). The subject lands have an area of 0.457 hectares and the proposal
involves the creation of one (1) additional lot with an area of 0.238 hectares. The
property is designated "Permanent Agricultural Reserve" by the Durham Regional Official
Plan and zoned "Agricultural (A-1)" by By-law 84-63.

The subject application was circulated to various agencies for comment by
both the Town and the Regional Planning Department. The following is a
summary of the comments received:
Town of Newcastle Public Works Department
"No objection, provided that the owner contributes to the costs of upgrading
Kurve Inn Road in accordance with Town Policy (ie: roadside ditching and
installation of culverts)."
Ministry of Transportation and Communications
"Although this Ministry has no objection to the proposed amendment, we will
require that all accesses be restricted to the side road with no direct
access to Highway No. 115/35.
This Ministry will require all buildings to be setback a minimum distance of
14m from our highway property line. Permits are required for all buildings
located within 45m of the highway property line".
The following agencies indicated no objection to the subject application:
- Town of Newcastle Fire Department
- Region of Durham Works Department
- P~inistry of Agriculture and Food
- Peterborough-Victoria Northumberland and Newcastle
Roman Catholic Separate School Board
- Region of Durham Health Unit
COMMENT:
No objections to the creation of the proposed residential lot were
identified through the circulation of the Official Plan Amendment
application. As well, the proposal would appear to comply with the Town's
criteria for identifying rural nodes and clusters. In that regard, the
Town's criteria specifies that a cluster sha11 contain a minimum of 3 and a
maximum of 6 existing building lots and that infilling may occur up to a
maximum of 3 additional lots. Rural clusters are also to have defined

borders on at least 3 sides. Staff note that there are 3 existing lots
which are bounded on the north and west by local roads and on the south by
Highway No. 115/35.
Notwithstanding the above considerations, Planning Department Staff have
concerns related to the creation of the proposed lot. Currently, the
unsevered lot as owned by the applicant only has an area of 0.457 hectares.
The applicant proposes the creation of a lot with an area of 0.238 hectares,
while the retained lot would only have an area of 0.219 hectares. The
minimum lot area for new lots in a "Rural Cluster" zone is 0.30 hectares.
Neither of the lots would comply with this requirement.
Staff note that an application (File: 83-7/D) to permit the creation of one
(1) additional lot submitted on the property immediately to the west was
approved in September, 1983 as Amendment No. 97 to the Durham Regional
Ufficial Plan. The amendment permitted the creation of one (1) additional
lot as a special exception to the Official Plan. Staff indicated no
objection to the proposed amendment. In comments to the Land Division
Comrittee on the subsequent severance application, Town Staff indicated no
objection provided that the new lot had an area of at least 0.4 hectares,
which was the minimum lot area for lots in the "Rural Residential" zone of
By-law 1592 of the former Township of Clarke. The lot as approved by the
Land Division Committee only had an area of 0.28 hectares; however, Staff
chose not to appeal the decision given that the principle of development had
already been established through the Official Plan Amendment.
Although Staff indicated no objection to an additional lot on the adjacent
parcel, Staff are concerned that the approval of the subject application
submitted by Mr. & Mrs. Shoobridge would establish a precedent for the
creation of lots in agricultural areas considerably small than the minimum
required by By-law 84-63. In this regard, it is respectfully recommended

that the Region of Durham be advised that the Town of Newcastle recommends
that Official Plan Amendment application 87-9/D be denied.
