OF DARLINGTON OUR FILE: O.P. 3.3(5) RECOt~lENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-196-87 be received; and 2. THAT the application to amend the Enniskillen Hamlet Development Plan File O,P.3,3(5) submitted by Kalee Investments Limited be approved in principle and forwarded to Regional Council for review and comment; and 3. THAT a copy of Staff Report PD-196-87 and Council's decision be forwarded to the applicant and the Region of Durham. BACKGROUND: On May 6, 1987, Kalee Investments Limited submitted an application to amend the Enniskillen Hamlet Development Plan to increase the maximum numer of lots permitted in the northwest quadrant of the Hamlet from "26" to "29". The applicant proposes to create an additional 3 lots on a 0.93 hectare parcel adjacent to Registered Plan lOM-786 and * fronting onto Salter Court (see key map). The subject lands are zoned "RH - Residential Hamlet and have sufficient frontage and area to permit the creation of 3 additional lots in conformity with the provisions of the zoning by-law. The applicant has indicated that ,,.2 ~ ~;`~ .~- REPORT NO.: PD-196-87 an old farm house currently located on the subject lands will be demolished. The following is a summary of the comments received on 'the subject application: Town of Newcastle Public Works Department Page 2. This Department's comments are as per the comments on the related Land Division Applications. Town of Newcastle Community Services Department Recommend 5% cash-in-lieu of parkland. Town of Newcastle Fire Department This Department has no objection to the above-headed application. This property is located outside of the recognized five mile response limit to a fire station and water supply for firefighting is by Fire Department tanker trucks. If the existing buildings on the property are to be demolished, they are not to be burnt. All materials are to be removed from the site via dump box or container. Region of Durham Health Unit Please be advised that this department has no objection to the above Official Plan. However the number of lots that are suitable for on site sewage disposal will be determined when the subdivision proposal or severances are circulated to this department along with other pertinent information. The following agencies have indicated no objection to the subject application: - Town of Newcastle Building Department - Central Lake Ontario Conservation Authority - Region of Durham Planning Department - Ministry of Natural Resources Section 9.11 of the Town of Newcastle Official Plan requires applications for development within a Hamlet to be accompanied by an Engineering Study based on test drilling wihich confirms soil conditions satisfactory for the effective operation of a private waste disposal system; no adverse effects upon existing water supplies and an adequate supply of potable water to ...3 ~,~ L®~ REPORT NO.: PD-196-87 Page 3 service the proposed development; and an adequate separation between water table and septic the fields. The applicant has been advised of this requirement but the necessary infor-nation has not, as of yet, been submitted. The applicant has applied to the Region of Durham Land Division Committee (Applications LD 409/87 and LD 410/87) for the creation of the proposed lots. In comments to the Committee meeting of June 29, 1987, Town Staff outlined the following conditions of approval. 1. payment of the appropriate lot development charges; 2. payment of an appropriate cash-in-lieu value of parkland dedication; 3. the Hamlet Plan Amendment being approved and final and binding; 4. to satisfy the Town of Newcastle Works Department in respect of a road widening along Scugog Road; and 5. comply with the conditions for the issuance of building permits and lot grading as set out in Plan 10M-786. COMMENT: Staff note that no objections have been identified through the circulation of the subject application. Requirements relating ~o 'i;fre dedication of the road widening and the payment of cash-in-lieu of parkland and lot development ci~arges can be addressed through the related Land Division applications. As indicated earlier, the engineering study regarding the viability of private services on the proposed lots has not yet been submitted. However, Staff note that a hydrologist's report submitted in respect of the adjacent plan of subdivision i ndi Gated that an adequate water supply could be obtained at a depth between 15rn and 77m at all locations within the subdivision. Water quality rnet required standards for all parameters tested, a1tV~ough the level of iron in the water was found to be close to the maxi mum acceptab 1 e 1 i mi t and may require treatii~e nt. ...4 /\~ ~,®~ REPORT NO.: PD-196-87 Page 4 Staff note that testing to determine the suitability of the soi 1 s within the proposed subdivision to suport private waste disposal systems was not undertaken. However, the Region of Durham Health Unit indicated no objection to either the subdivision plan or the subject application. * Although the engineering study required pursuant to the Official Plan has not been submitted to-date, Staff see no merit in delaying the further processing of the subject application given the demonstrated viability of private services on the adjacent registered plan. It is therefore recommended that the application to amend the Enniskillen Namlet Developrr~ nt Plan be approved in principle and forwarded to the Region of Durham for their review and comment. The draft amendment is attached hereto. Staff will review the engineering study when submitted and if the findings of the study are favourable and the Region indicates no objection to the proposed amendment, Staff will prepare a further report to Council advising of same and forwarding the amendment for final approval. BASIS OF AMENDMENT This amendment to the Hamlet Development Plan for the Hamlet of Enniskillen is based upon an application submitted to the Town of Newcastle to amend the ~ Plan to permit the development of three (3) additional residential lots within the northwest quadrant of the Hamlet. ACTUAL AMENDMENT 1. Schedule "1" to the Hamlet Development Plan for the Hamlet of Enniskillen is hereby amended by changing from "26" to "29" the maximum number of residential lots permitted in the northwest quadrant of the hamlet as shown on the attached Schedule "X" hereto. 2. Schedule "X" hereto shall form part of this Amendment. IMPLEMENTATION The provisions set forth in the Town of Newcastle Official Plan regarding the implementation of the Plan shall apply in regard to this Amendment.
