RECON~'(ENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-182-87 be received; and
2. THAT the Ministry of Municipal Affairs be advised that the Town of Newcastle has no
objections to the proposed revisions to draft plan 18T-75362, dated March 25, 1987,
prepared by G.M. Sernas and Associates Limited to permit the development of twenty-
four (24) residential lots and that draft Condition Number 11c) be revised by
deleting any reference to Lots 44 to 52 inclusive and replacing same with the
corresponding lot numbers as shown on the revised plan, include the lot nu mbering of
former Block "A", being Lots 19 to 24 inclusive and by the addition of a further
condition being the reconstruction of the Scugog/Newcastle boundary road from Old
Scugog Road to Region a1 Road No. 57 to the satisfaction of the Town of Newcastle and
Township of Scugog, and by ac!<justing the conditio ns of approval as necessary to give
effect to same; and
3. THAT the application submitted by Mr. Kevin Tunney on behalf of the Owners to rezone
said lands within Part of Lot 18, Concession 1 former Township of Darlington to
permit the development of twenty-four (24) residential lots be approved and the
by-law attached hereto be forwarded to Council for approval; and
4. THAT a copy of said report be forwarded to the Ministry of Municipal Affairs in
consideration of Recommendation No. 2 above; and
5. THAT the Owners be so advised.

BACKGROUND AND COMMENT:
Staff would note for the Committee's information that draft Plan of
Subdivision 18T-75362, as previously approved, has proceeded to date,
through phased development, (Plans 10M-753, 10M-765 and lUM-770) with the
exception of the lands north of the Canadian Pacific Railway being the
subject of submitted applications. Additionally, it is noted the draft
conditions of approval included the potential development of said lands and
improvements as required to the boundary road between the Town of Newcastle
and the Township of Scugog.
* The attached key plan illustrates the limits of the lands as previously
approved. Within the terms of the Subdivision Agreement, specifically
Schedule "N", it was acknowledged that, the Owner was to construct the road
allowance between the former Townships of Darlington and Cartwright from Old
Scugog Road to its most easterly intersection of Street "D" to the
satisfaction of the Director of Public Works.
Staff would note that in consideration of the proposed revisions to the
draft plan, the improvements to the boundary road would be expanded easterly
to the intersection of Regional Road No. 57. This extension would provide
the necessary frontage to Lots 19 to 24 inclusive. In essence, the
application to review the draft plan wou'Id increase the total number of lots
from fourteen (14) to twenty-four (24), and delete the provision of Street
"D". This revision would also improve access to the north part of the
Hamlet, particularly emergency vehicles, by way of the grade-separated
Regional Road.
In addition to the Ministry's request for comment on the draft plan, an
application submitted on behalf of the Owners was received by Staff on May
5, 1987 to rezone the said lands to an appropriate zone category to permit
the development of twenty-four (24) residential lots.
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the

subject lands. Staff would note that no objections to the proposal were
received at the writing of this report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtain comments for other departments and agencies. Staff would note the
following, in providing comments, offered no objections:
- Town of Newcastle Fire Department
- Town of Newcastle Building Department
- Kawartha Conservation Authority
- Ministry of Agriculture and Food
The Durham Regional Health Unit in responding, offered no objections to the
application, however, noted that all lots are to be served by drilled wells.
Staff would note for the Committee's information that the subdivision
agreement requires that, prior to the issuance of a building permit, the
Town is to have received written confirmation from the Durham Regional
Health Unit that there is an adequate potable water supply to serve the
proposed building and that a permit has or wi11 be issued for the
installation of a private sewage disposal system for the property.
The Town of Newcastle Works Department, i n reviewi ng the appl ication of fer
no objections to the proposal, noting that the terms within the existing
development agreement require the Owner to construct the boundary road to
the satisfaction of the Director of Public Works. The proposed changes
would require the extension of the limits of the construction of the
boundary road easterly to Regional Road No. 57. Staff would acknowledge
that, in consideration of the proposed revisions, Condition No. 4 of the
draft approval requiring the Owner to provide a 0.3 Metre Reserve along the
south side of the boundary road abutting Block "A" (Lots 19 to 24 on revised
plan) would no longer be required. This, of course, is dependent on
Council's approved of the revised plan of subdivision.

The Region of Durham Planning Department has indicated to Staff, verbally,
that they are in the process of responding directly to the Ministry of
Municipal Affairs to the effect that Regional Staff have no objections to
the proposed changes.
Staff would note that the proposed plan provides an additional ten (10) lots
from the draft plan; six (6) comprising the area designated Block "A" -
future development. The lot sizes proposed vary from 3220m2 (Lot 18) in
size to 7890m2 (Lot 1 through G).
In consideration of the above-noted comments, the depth of the proposed lots
and extensive vegetative cover, Staff would offer no objections to the
applications for draft plan revisions and rezoning to permit the development
of ten (10) additional residential lots. Furthermore, as noted within the
Report, the applicant is responsible for the compliance with the existing
Subdivision Agreement and additional requirements necessary; i.e. road
construction, boundary road, to implement the development.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows;
1. Schedule "12" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Agricultural (A)" and
"Residential Hamlet Exception (RH-3 )" to "Residential Hamlet (RH)" as
shown on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
