RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-185-87 be received; and
2. THAT the application filed by Mrs. Jean Payne be referred to Staff fora further
report pending Staff's receipt of the comments of the Ministry of Agriculture and
Food and the Region of Duham.
BACKGROUND AND COMMENT:
On April ?_8, 1987, the Planning Department received an application filed by Mrs. Jean
Payne to rezone a parcel of land within Part of Lot 29, Concession 4, former Township of
Clarke to permit the development of a Node/Cluster.
In consideration of same, the application was circulated (May 11, 1987) to the various
Town Departments and outside agencies for their review and comment thereon. Staff would

note that the comments of the Ministry of Agriculture and Food and the
Region of Durham Planning Department have not been received. As Committee
is aware, Staff prior to providing a recommendation in respect of a rezoning
application must review all pertinent comments. In consideration of the
request, and compliance with the Regional Official Plan and Agricultural
Code of Practice, the comments of each authority/department are essential.
Compounding the application and the applicant's requests, Staffs receipt of
a copy of a letter from the Ministry of Agriculture and Food, addressed to
Mr. Murray Payne (dated prior to the submission of the rezoning
application), noting therein that the request to create a new non-farm
residential lot on subject lands would not comply with the policies of the
Foodland Guidelines.
Inasmuch as Staff has been unable to confirm the above with the Ministry nor
determine the extent of the non-conformity, nor has received a reply to the
Town circulation of DEV 87-37, Staff are not in a position to provide a
qualified recommendation.
In addition, receipt of the comments of the Region of Durham, in
consideration of the provisions of the Regional Plan and compliance with
same, is also appropriate.
Upon receipt of the above, Staff will forward the necessary report for
Committee's consideration.
