SUBJECT: ONTARIO HYDRO, DARLINGTON GENERATING
STATION, SUPPLEMENTARY AGREEMENT #7

It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. That this report be received;
2. That Council adopt the attached by-law authorizing the
signing of the attached amendment to Supplementary Agreement
#7; and
3. Thereafter staff take the appropriate action to execute
the Agreement.
BACKGROUND AND COMMENT:
As members of Council will no doubt recall, general agreement had been
reached as to the understanding of the proposed amendment to
Supplementary Agreement #7. However, there was some concern as to the
exact wording with respect to the proposed amendment. These matters
have now been resolved and the proposed amendment to Supplementary
Agreement #7 appears to be in order.

BY-LAW 83-151
being a by-law to authorize the execution of an Amending
Agreement with Ontario Hydro, amending Supplementary
Agreement #7, with respect to Courtice Urban Area Storm
Water Management, Darlington Generating Station "B" account.
The Council of the Corporation of the Town of Newcastle
HEREBY ENACTS AS FOLLOWS:
That the Mayor and Clerk are hereby authorized to executed on behalf
of the Corporation of the Town of Newcastle and seal with the
Corporation Seal, an Agreement between Ontario Hydro and the said
Corporation, amending Supplementary Agreement #7 with respect to
Courtice Urban Area Storm Water Management, Darlington Generating
Station "B" account.

THHIS AMENDING AGREEMENT MADE IN TRIPLICATE THIS DAY OF

ONTARIO HYDRO,
Hereinafter referred to as the "CORPORATION"
OF THE FIRST PART
- and -
THE REGIONAL MUNICIPALITY OF DURHAM,
Hereinafter referred to as the "REGION"
OF THE SECOND PART
- and -
THE CORPORATION OF THE TOWN OF NEWCASTLE,
Hereinafter referred to as the "TOWN"
OF THE THIRD PART

WHEREAS the Corporation, the Region, and the Town have entered
into an Agreement (hereinafter referred to as "Supplementary
Agreement No. 7") with respect to Courtice Urban Area Storm
Water Management System.
AND WHEREAS the parties hereto agree to amend the aforesaid
Supplementary Agreement No. 7;
NOW THEREFORE, in consideration of the mutual agreements,
covenants, and provisions contained herein, the parties hereto
agree as follows:

1. Supplementary Agreement No. 7, between the
Corporation, the Region, and the Town, is
hereby amended by increasing the sum men- ( /
tioned in paragraph 1 from $150,000 to
$180,000.
2. Supplementary Agreement No. 7, between the
Corporation, the Region, and the Town, is
hereby further amended by adding thereto a
new paragraph 6 as follows:

Paragraph 6:
That in addition to the monies provided for
under paragraph 1 of this Supplementary Agreement,
the Corporation agrees to pay to the Town from
the Station "B" Account a special allowance in
the sum of $60,000 hereinafter referred to as
"special allowance", to assist in the funding
of storm sewer facilities in the Courtice Urban
Area in advance of an evaluation of impact
arising out of the Darlington Generating Station.
The Town shall repay this sum of $60,000 to
Station Account "B" by paying four annual install-
ments of $15,000 each, commencing on April 1, 1986
and ending on April 1, 1990.
IN WITNESS WHEREOF the parties have hereto affixed their
corporate seals by the hands of their proper signing officers,
duly authorized in that behalf.
