That this report be received; and 2. That the attached Supplementary Agreement Number 9 be approved by Council; and 3. That the attached by-law be adopted authorizing execution of the agreement; and 4. That the Clerk forward copies of the Agreement to the Region of Durham for execution after execution by the Town. BACKGROUND AND COMMENT: Further to the Hydro Liaison Committee meeting of last December, the Town has now received a finalized version of Supplementary Agreement Number Nine. B E T W E E N: -and- --and- ONTARIO HYDRO Hereinafter referred to as the "Corporation - OF THE FIRST PART THE REGIONAL MUNICIPALITY OF DURHAM Hereinafter referred to as the "Region" OF THE SECOND PART THE CORPORATION OF THE TOWN OF NEWCASTLE Hereinafter referred to as the "Town" OF THE THIRD PART M1 Whereas the Corporation and the Town have entered into an Agreement (hereinafter referred to as the Newcastle Agreement), with respect to the social, economic and financial impacts arising out of the construction and operation of the Darlington Generating Station (hereinafter referred to as the Station) on the Town dated March 22, 1977; C -z- AND WHEREAS the Corporation, the Region, and the Than have entered into an Agreement (hereinafter referred to as the Regional Ac-,eement) with respect to the social, economic and financial = upacts ar+.eiag oet of the and operation of the Station on the Region and the Tbwn, dated August 8, 10,77; AND WHEREAS the Newcastle Agreement and the Regional Agreement provide for the entering into of supplementary agr, =ents beteeen the Corporation, the Region and the Town; AND WHEREAS the Corporation, the Region and the Town have entered into a Supplementary Agreement entitled Commurity Impact Monitoring Program which involves collecting and updating data cn certain impact items which may be affected by the construction and operation of the Station; AND WHEREAS, it is seen that, the social serpiges as,:M ell as 1�he,kct;ltural facilities of the Town of Newcastle are. to be;subject to an,impact dge„ to the increase in demand placed upon them by the growing inflow of Darlington construction workers and their families, it ie. deemed necessary to advance funds to improve these services and facilities for the advancement of improvements; AND k;HSREEAS the Corporation, t^ 'I glop en;: the a5:: .. _:. ioG-. has undertaken initiative to advance .c ite .,ibrary System musel.m.s; 5670Y, M C NOW, THEREFORE, WITAESSETH that in Consida:rarion .Of the Covenants hereinafter contained and for other good and valuable co ;"_deretic , the Cbrooration, the Region, and the Torn hereby agree as-Pollows: I. The Orporation agrees to pay to the Town from Station Account "B" up to the sum of 435,000 in advance of the evaluation of the future financial impact to be incurred by the Town in advancing improvements to the Town's Library system. On completion of advancement of the improvements, the Town shall submit a claim for payment from Station Account "B" for any financial impact incurred by the Town. 2. The corporation agrees to pay the Town from Station Account "B" up to $30,000 in advance of the evaluation of the future financial impact to be incurred by the Town in expanding its Museum facilitier allocating $20,000 for the Bowmanville Museum improvements and $S,O�o for each of the Orono and Clark Kuzeums. On completion or ab�.,ndonment of expanding Museum facilities, the Town shall submit a claim for -:�revment from Station Account "B" for cny financial im-pact incurred thB T�•:�n. - d - The recitals mentioned in this Agreement form part of this Agreement. Copies of the Agreement are returned herewith. Please make the necessary amendment in accordance with the above resolution and return to us for execution.
