REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JANUARY 17, 1983
REPORT NO.: ADMIN-8-83 (PD-16-83)
SUBJECT: COURTICE HEIGHTS SOUTH DEVELOPMENT AGREEMENT
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1. That Report ADMIN-8-83 (PD-16-83) be received;
and
* 2. That the attached By-law authorizing execution
of a Subdivision Agreement between The
Corporation of the Town of Newcastle and Claret
Investments Limited, Rexgate Holdings Limited,
Flecherdon Investments Limited, Reinhold Litz
Jr., John Kastel and Mary Kastel be approved;
and
3. That upon Council approval of Staff Report
ADMIN-7-83 in respect of Development Charges
within The Corporation of the Town of
* Newcastle, that the attached Subdivision
Agreement between The Corporation of the Town
of Newcastle, Claret Investments Limited and
Rexgate Holdings Limited, Flecherdon
Investments Limited, Reinhold Litz Jr., John
Kastel and Mary Kastel be approved; and

4. That staff be authorized to proceed with the
tendering of Phase I of the storm water
drainage facilities as designed by Totten Sims
Hubicki which will permit the development of
the First Phase of draft plan 18T-76027.
* 5. That the attached By-law authorizing execution
of an Agreement with Her Majesty the Queen, in
right of the Province of Ontario, as
represented by the Minister of Municipal
Affairs and Housing, be approved;
6. That the following Resolution be forwarded to
Mr. C. Bennett, Minister of Municipal Affairs
and Housing:
"WHEREAS The Corporation of the Town of
Newcastle has proceeded with the calling of
tenders for the installation of storm water
faciities in the Courtice Urban Area in
accordance with an agreement with the Ministry
of Municipal Affairs and Housing for the
provision of storm sewers under the Courtice
Housing Action Program Loan;
NOW THEREFORE BE IT RESOLVED that the Council
of The Corporation of the Town of Newcastle
hereby requests that in accordance with the
commitment of November 25, 1981, that the
Minister execute a revised Ontario Housing
Action Program Loan with the Town of Newcastle
and forward the loan amount of $350,000 to the
Town as soon as possible."
BACKGROUND:
Following upon expiry of a Subdivision Agreement between The
Corporation of the Town of Newcastle and Claret Investments
and Rexgate Holdings, which Agreement had been approved in
1978 by By-law 78-55, Town staff commenced re -negotiation of
the subject Agreement as requested by the Applicants. These
negotiations have resulted in the preparation of a new
Agreement (copy attached) covering the development of the
lands in question, being Plan of Subdivision 18T-76027, and
addresses standard municipal concerns and particularly storm
water management and development charges attributable to the
subject subdivision.

The proposed Agreement has been reviewed by Town staff,
including our solicitor, and is acceptable to the
applicants. Subject to the concurrence of Committee and
Council with the terms of the Agreement, it would be
* appropriate to approve the attached By-law authorizing
execution of the subject Agreement, and at the same time
provide authorization to staff to proceed with the tendering
of the First Phase of the storm water drainage facility
required to permit the development of this subdivision.
Staff note that a contract in respect of this storm water
facility must be awarded by the Town prior to the March
31st, 1983 deadline which has been attached to the OHAP Loan
to be provided to the Town in respect of this project.
We would also note that in view of the fact that prior
agreements in respect of OHAP were with the Ministry of
Housing, now Municipal Affairs and Housing, and were
authorized by the Council of the day, it would perhaps be in
order to reaffirm the necessary authorization for execution
of an Agreement in respect of the $350,000 OHAP Loan. A
* By-law to authorize this action is also attached herewith.
Inasmuch as the development charges referred to by the
subject Agreement have been based upon the draft Development
Levy Policy which is the subject of Staff Report ADMIN-7-83,
approval of this Agreement is contingent upon Council
approval of that policy. Should that policy not be
approved, staff would not recommend approval of the subject
Development Agreement.

being a By-law to authorize the entering into of an Agreement with
The Corporation of the Town of Newcastle and Claret Investments
Limited, Rexgate Holdings Limited, Flecherdon Investments Limited,
Reinhold Litz Jr., John Kastel and Mary Kastel.

The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal, an Agreement between Claret Investments Limited,
Rexgate Holdings Limited, Flecherdon Investments Limited, Reinhold
Litz Jr., John Kastel and Mary Kastel and the said Corporation dated
the day of 1983, in the form attached hereto as
Schedule
2. THAT Schedule "X" attached hereto forms part of this
by-law.
