SUBJECT: BY-LAW ADOPTING COUNCIL ENDORSED
CHANGES TO BY-LAW #79-90
(NON -UNION BENEFITS)
RECOMMENDATIONS:
1. That the attached by-law be forwarded to Council
for approval.

As Committee members are aware, Council has endorsed a number of changes to
By -Law #79-90 respecting the non -union benefits policy and has requested that
a by-law be prepared for adoption, giving effort to the changes (G.P.A.
Resolution G.P.A. #892-82 adopted by Council July 19, 1982).

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW #82- 128
Being a by-law to amend By -Law #79-90, being a by-law to adopt a Statement
of Policies for Non -Union Staff.
The Council of the Corporation of the Town of Newcastle hereby enacts as
follows:
1. Schedule "A" to By -Law #79-90 is amended by deleting
the following paragraphs in respect of:
Vacations with Pay
Dental Plan
Educational Courses
Overtime
General
and by inserting the following paragraphs:
Vacations With Pay
Employees with less than one (1) year of service, shall be entitled to one (1)
day per month of service, to a maximum of ten (10) working days. No annual
vacation may be taken until the staff member has successfully completed the
required probationary period.
Employees with one (1) to four (4) years of service shall be entitled to two
(2) weeks.
Employees with four (4) years of service, but less than ten (10) years of
service, shall be entitled to three (3) weeks.
Employees with ten (10) years of service, but less than twenty (20) years of
service shall be entitled to four (4) weeks.
Employees with twenty (20) years of service or more shall be entitled to five
(5) weeks.
All vacations shall be taken in the calendar year based on the employees
vacation entitlement as completed to May 31 of that same calendar year.
Vacations may not be carried,over from year to year except by permission of the
Department Head and/or Chief Administrative Officer.
The scheduling of vacations within the calendar year are subject to the approval
of the Department Head and/or the Chief Administrative Officer. Scheduling
should be undertaken on the basis of length of service.

Courses will be made available to all employees with pay and expenses accord-
ing to the following:
1. An employee must be sent by a Department Head;
2. A previous budget allowance must have been made;
3. On successful completion the applicant will be
reimbursed for course related expenses.
Overtime
Monetary compensation for work performed beyond normal hours for the following
list of employees shall not be paid, however such an employee may earn five
(5) additional working days in lieu of overtime worked, on the basis of 1}
hours of time off for 1 hour of overtime worked.
Staff on the following list may be allowed additional time off with pay in
lieu of overtime for appropriate reasons as may be determined by the
Department Head or Chief Administrative Officer;

Monetary compensation for work performed beyond normal hours for the following
list of employees shall be paid at the rate of one and one half time (1})
his/her regular hourly rate for all hours actually worked in excess of the total
hours normally worked each week and with the approval of the appropriate
Department Head. Staff on the following list may be allowed additional time off
with pay in lieu of overtime rather than receiving additional pay, at the
discretion of the Department Head and/or Chief Administrative Officer provided
appropriate reasons are given:

All non -union secretarial personnel
Overtime work beyond the normal working hours of the Corporation will be
required commensurate with the position without compensation, except as
provided for under this section.
Probation Period
All new employees shall be on probation for a period of six (6) calendar months,
-- or for such lesser period as may be specified with specific terms and conditions
of employment, reached with the individual employee.
Clothing Allowance
The Town will provide the following staff with an annual allowance for the
purchase of protective clothing, necessary for the performance of their jobs:
Foreman (Works)
Foreman (Parks and Recreation)
Chief Building Official
Superintendent of Works
Leave of Absence Without
Any leave of absence requested by a member of staff unless otherwise provided
for in this policy, shall not be permitted, unless approved by the Department
Head and/or the appropriate Standing Committee of Council.
General
Wherever the singular or masculine is used in this Policy, it shall be
construed as if the plural or feminine has been used, where the context so
requires.
It shall be the responsibility of each employee to constantly provide updated
information to the Chief Administrative Officer relative to his personal status
including change of address, telephone number, marital status, health status,
educational improvements, number of dependents and other related matters.
The Town may from time to time, establish certain conditions or benefits not
handled in this policy in respect of the employment of individual employees.
Such conditions or benefits may be established through the adoption of by-laws
describing individual "terms and conditions" of employment.

2. Schedule "A" to By -Law #79-90 is further amended
to deleting all reference to the "Town Manager"
and by inserting the words Chief Administrative
Officer in all places "Town Manager" appears.
By-law read a first and second time this 20th day of September 1982
