NO. 82 - 47 SUBJECT: BLOCK "J" - PLAN 702 WAVERLY GARDENS - PHASE II CORRESPONDENCE FROM MR. J. RALFE RECOMMENDATIONS: 1. That this report be received; and 2. "That Mr. J. Ralfe be advised that the Town is prepared to execute an agreement with the owners of Lots 85 and 86, abutting Block "J" to permit the owners to landscape and fence Block "J". BACKGROUND AND COMMENT: The attached correspondence was referred to the Chief Administrative Officer for a report to the General Purpose and Administrative Committee. Block "J" of Registered Plan 702 Phase II of Waverly Heights was identified as a pedestrian walkway in the draft plan approval of the subdivision and in the subdivision agreement executed in 1973. No pedestrian walkway has been constructed on Block :J: and the subdivision agreement has been cleared and releases registered on title. It appears that Block "J" was intended to provide pedestrian access to the Bowmanville Creek Valley lands, to the east of the subdivision; lands which remain in private ownership at this time. Block "J" appears to also be part of the storm drainage system for the subdivision plan in that there is a storm sewer outfall running through Block "J" from the Hetherington Drive cul-de-sac. NO. 82 - 47 Page 2 In order to maintain the storm sewer system and to allow for the future possible development of Block "J" as a pedestrian walkway it is recommended that Block "J" remain in public ownership. However, until such time as the Town wishes to construct a walkway, staff have no objection to the land being incorporated into the adjacent lots; ie; fenced and landscaped at the expense of the owners of the abutting lots. An agreement with the owners would be appropriately registered on title, including a clause or clauses to the effect that Town may enter onto Block "J" at any time to construct the walkway and to maintain the storm sewer pipe and outfall.
