That this report be received; and 2. That Council execute the attached agreement with Reg.T. Smith Construction for the restoration of the porch of the Bowmanville Museum; and 3. That Council adopt the attached by-law giving effect to (2) above. BACKGROUND AND COMMENT: As members of Committee are aware, three proposals for undertaking the restoration of the porch at the Bowmanville Museum were received by the Town. The proposals have been reviewed by the Bowmanville Museum Building Committee (correspondence attached) and the proposal from Reg.T. Smith Construction recommended for approval. Town staff have reviewed the proposals as to the adequacy of insurance coverage and have been advised that there is no extra insurance coverage required on the Town's part. Staff recommend that the proposal from the firm of Reg.T. Smith Construction be accepted and have provided copies of this report to D. Mills, Architect and the Museum Board. Please note that Schedule "A" to the Agreement has not been appended to the Agreement at this time due to its bulk. A copy is available in the Administrator's office. Smith Construction for the reconstruction of the Bowmanville Museum Porch The Council of the Corporation of the Town of Newcastle HEREBY ENACTS AS FOLLOWS: THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle and seal with the Corporation Seal, an agreement between Reg. T. Smith Construction and The Corporation of the Town of Newcastle for the reconstruction of the porch on the Bowmanville Museum, located at 37 Silver Street. T. SMITH CONSTRUCTION hereinafter called the "Contractor" of the second part WHEREAS Council deems it appropriate to enter into an Agreement for the reconstruction of the porch of the Bowmanville Museum Building, Silver Street, Bowmanville; and WHEREAS the Contractor has offered to undertake the reconstruction on the basis of the drawings and specifications prepared for the Bowmanville Museum Board by D. A. G. Mills, Architect; and WHEREAS the Town has approved the drawings and specifications and has invited public proposals to undertake the reconstruction: NOW THEREFORE in consideration of the promises and mutual covenants and agreements herein contained, the parties hereto mutually covenant and agree as follows: 1. The Contractor agrees to reconstruct the porch of the Bowmanville Museum in accordance with the plans and specifications prepared by D. A. G. Mills Ltd, and attached hereto as Schedule "A" to this Agreement; and 2. The Contractor agrees to undertake (1) above in accordance with his proposal of December 15 1981, attached hereto at the cost specified; and 3. The Contractor agrees to save harmless, the Town from any damage, injury, actions or causes of actions resulting from the performance of the work specified in this agreement. 4. 'urther to the plans, our execution of the job will consist of the dipping of the material into the preservative rather than using the brush or roller . This will give better penetration. If the jab is undertaken during the winter months, we would have to bring all of the framing material into the shop to thaw it out and dry it a little, otherwise there would be little or no penetration of the preservative into the spruce. The pine flooring would be all righty because it is under cover. We also use galvanized nails on all exterior work. This is a further protection of rusting and wood rotting around the nails and the discolouring of the paint. During the course of construction, we paint all end cuts of beams, joists and flop ring material at the job site for added protection. At this meeting, the Committee approved the recommendation put forward by the Architect to have the Town of Newcastle consider entering into contract with the firm of Reg. Smith Construction, Oshawa, with a price of $9,057.00 Please advise this office when a contract has been awarded. Included with this letter are copies of proposals submitted. Yours truly, David A. G.
