NO. 43-81 40 TEMPERANCE STREET BOWMANVILLE, ONTARIO LIC3A6 TELEPHONE 623-3379 MEETING OF DECEMBER 14 1981 RE: PRESENTATION BY MR. J. VELDHUIS REGARDING DISPOSAL OF WASTE AT PORT GRANBY DISPOSAL SITE RECOMMENDATIONS: 1. That this report be received; and 2. That Council consider adopting the following resolution for submission to the Atomic Energy Control Board, Eldorado Nuclear and the Ontario Ministry of the Environment; "Whereas the Town of Newcastle has been advised that there is material being disposed of at the Port Granby Waste Disposal Site that may not be provided for under the terms of Port Granby Waste Disposal Licence; and Whereas the Town has not been advised of such disposal; and 10 Whereas the Town of Newcastle is most concerned about this situation: Be it now resolved therefore, that the Town of Newcastle hereby calls on eTic Energy Control Board and Eldorado Nuclear Ltd. to immediately advise the Town as to the nature and extent of current dumping at the Port Granby site and to advise the Town of Newcastle of any contemplated change in the operating procedures of the Waste Disposal facility, both now and in the future" PEI Report to Council -2- Admin. No. 43-81 BACKGROUND AND COMMENT: At the Council meeting of October 5 1981, Mayor Rickard submitted a report to Council outlining the previous resolutions passed by Newcastle Council in respect of the Port Granby Waste Disposal site. The report was received by Council and referred to Staff. Subsequent to the October 5 1981 meeting, Mr. J. Veldhuis addressed Town Council (November 30 1981) in respect of the current situation at the Port Granby Waste Disposal and asked Council to consider three alternative courses of action: 1. Forwarding a letter of reprimand to Eldorado Nuclear and the A.E.C.B., 2. Striking a Committee of residents and elected persons to communicate directly with Eldorado Nuclear and the A.E.C.B., and 3. Taking out an injunction against Eldorado Nuclear Ltd. The matters were also referred to Staff. Staff have met with Mr„ Veldhuis in respect of his presentation to Council and have drafted the resolution within the recommendations for Council's consideration, on the basis of the conversation with Mr. Vc1dhuis. Mr. Veldhuis and S.E.A.P. group are concerned that at this time, material being disposed of at the Port Granby site is being done, without the prior knowledge or consent of the Town of Newcastle. He is concerned that the current disposal operators are not within the provisions of the Licence to Operate the Port Granby Facility. Staff feel that the recommended resolution would appropriately be forwarded to the Agencies concerned and that Council may wish to consider the other courses of action outlined by Mr. Veldhuis in greater detail depending on the reply to the resolution. Mr. Veldhuis and Staff briefly discussed the possibility of establishing an ad-hoc committee of concerned residents and members of Council to liaise with the A.E.C.B. and Eldorado Nuclear Ltd., on an ongoing basis. ..3 Report to Council -3- Admin. No. 43-81 Staff feel that there is merit in the suggestion, failing the regular dissemination of information by Eldorado Nuclear Ltd. and by the A.E.C.B., Staff feel this possibility bears further discussion by Council. In respect of seeking an injunction, to halt operations at the Port Granby site, Staff feel that it would be at least extremely premature for the Town to contemplate such action on the basis of the information received to date. Staff feel that Council should, as recommended, request the agencies concerned for information and consider the establishment of a liaison committee as noted above.
