THAT Report PD-151-87 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of May 7, 1987. This list includes the file number, applicants name, site location, type of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments on the applications and the Committee of Adjustment's decision. Carrol Clemens APPLICATIONS: A 33/87 - Leo Choloniuk, Lot-35, Concession 2, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to the existing commercial building leaving a 1.6 m side yard, instead of the required 5 m side yard. Mr Doug Duffy appeared in support of this application. Mr. Wilsen and Mr. Charewicz appeared with interest in this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Herring, seconded by Mr. Murdoch, "THAT as the proposed variance would appear to conform with the intent of the Official Plan and would not have a detrimental effect on the surrounding area, and as the narrower side yard would allow for more efficient use of the remaining part of the lot, permission is GRANTED to construct an addition to the existing commercial building leaving a 1.6 m side yard, instead of the required 5 m side yard." Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a commercial plaza with a 0 side yard and a common wall, instead of the required 5 m side yard and pro- viding 2 loading spaces, instead ,of the required 3 spaces. Mr. Provenzano appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Herring, "THAT as the proposed variance would appear to conform with the intent of the Official Plan and would allow the efficient development of a joint building with a common firewall that would be appropriate for the area, permission is GRANTED to construct a commercial plaza with a zero side yard and a common wall, instead of the required 5 m side yard and providing 2 loading spaces instead of the required 3 spaces." Application was made for relief from zoning by-law requirements in order to permit the applicant to create a:lot with a frontage of 88 feet (26.82 m), instead of the required 30 m frontage and an area of 17,424 sq. ft. (1618 sq. m), instead of the required 3000 sq.m. Mr. & Mrs. Bielowski appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, Seconded by Mr. Reicheld, "THAT as the requested variance does not appear to offend the intent of the Official Plan or Zoning By-law and would not appear to have a detrimental " . effect on the surrounding neighbuorhood but would rather have similar frontage and area to the surrounding properties, this variance is GRANTED to create a lot with a frontage of 110 feet and an area of 1900 sq. m. This approval is conditional upon approval of the Regional Health Department." "CARRIED" A 37/87 - Leonard & Leona Bielowski, Lot 23, Conc:s:2, Darlington. Application was made for relief from zoning by-law requirements in order.~to.permit the applicant to create alot with a frontage of 88 feet (26.82 m), instead of the required 30 m frontage and an area of 26,135 sq. ft. (2438 sq. m), instead of the required 3000 sq. m. Mr. & Mrs. Bielowski appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Reicheld, "THAT as the requested variance does not appear to offend the intent of the Official Plan or Zoning By- law and would not appear to have a detrimental effect on the surrounding neighbourhood but would rather hava a similar frontage and area to the surrounding properties, therefore this variance is GRANTED to create a lot with a frontage of 66 ft.(instead of the requested 88 ft. frontage) and an area of 2000 sq. m. This approval is conditional upon Regional Health Department approval." "CARRIED" Committee of Adjustment Meetin, May 7, 1987..... A 38/87 - Raymond & Edna Hamel, Lot 32, Concession 7, Clarke.. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a single family dwelling leaving a front yard of 6 m, instead of the required 25 m front yard. Mrs. Hamel appeared in support of this application. No other .person appeared in support of or in opposition to this application. Moved by Mr. Payne, seconded by Mr. Barrie, "THAT as the requested variance does not have an adverse effect on the intent of the Official Plan or Zoning By-law and will not have a detrimental effect on the surrounding properties, permission is GRANTED to permit the construction of a single family dwelling, leaving a front yard of 6 m. "CARRIED" A 39/87 - Andy & Mike Kadykalo, Lot 32, Conc. 2, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition 1:o the existing legal non-conforming commercial use. Mr. Kadykalo appeared in support of this application. No other person appeared in support of or in opposition to this application.
