RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-153-87 be received; and
2. TNAT the application to amend the Enniskillen Hamlet Development Plan submitted by
Ms. Barbara Thajer be approved in principle and forwarded to Regional Council for
review and comment; and
3. THAT a copy of Staff Report PD-153-87 and Council's decision be forwarded to the
applicant.
BACKGROUND:
On March 26, 1987, the Planning Department received an application submitted by Ms.
Barbara Thajer to amend the Enniskillen Hamlet Development Plan to increase the maximum
number of lots permitted in the southeast quadrant of the Hamlet from "22" to "23". The
application seeks to sever Lot 19, Plan lOM-775 into two (2) residential building lots.

The Town of Newcastle Official Plan (Section 9.11) states that an
application for development by registered plan of subdivision or consent
shall be accompanied by a detailed Engineering Report based on test drilling
which confirms soil conditions satisfactory for the effective operation of a
private waste disposal system, no adverse effects upon existing water
supplies and an adequate supply of potable water to service the proposed
development, and an adequate separation between water table and septic ti le
fields. In accordance with this requirement, the applicant submitted a
letter from Morrison Beatty Limited, Consulting Engineers and
Hydrolgeologists. The letter is summarized below:
"Morrison Beatty Limited completed a groundwater availability study in
April 1986 for the 22-lot subdivision. Based on the findings of the study
we concluded that there was an adequate supply of groundwater for
individuals wells. A description of the hydrogeological conditions on the
site may be found in our report (Groundwater Availability Study, Proposed
Residential Subdivision, Part of Lot 18, Concession 7, Township of
Darlington; Morrison Beatty Limited, April 1986). We recommended that the
subdivision be draft approved on the basis of a sufficient groundwater
supply.
We have reassessed the geologic and hydrogeologic data available for the
area and conclude that there is an adequate quantity of groundwater for a
23-lot subdivision. This assssment is based on the same recommendations
outlined in our report. The recommendations are as follows:
1. Groundwater development in the upper aquifer be restricted because of
the vulnerability of this zone to contamination. Development in the
lower overburden aquifer is recommended.
2. The well on the severance lot should be drilled, equipped with steel
casing and a well screen and properly grouted.
The depth to the lower overburden aqui fer i s about 56m (185 ft) on-site,
based on the records of the two test wells on the site. The thickness of
the aquifer is about 5m. Further details may be found in the report
referenced above."
Copies of the letter were forwarded to the Ministry of the Environment and
the Region of Durham Health Unit for their review and comment.
In accordance with Departmental policy, the subject application was
forwarded to various agencies for comment. The following is a summary of
the comments received to date:

Region of Durham Planning Department
"We have reviewed this matter and have no comments to make. The Region's
conditions financially and otherwise can be dealt with through the related
Land Division application.
As you are aware, any amendment to a Hamlet Development Plan must be
reviewed by Regional Council prior to adoption by your Council."
The following agencies indicated no objection to the subject application:
- Town of Newcastle Fire Department
- Region of Durham Health Unit
Comments are still to be received from the following agencies:
- Town of Newcastle Public Works Department
- Town of Newcastle Community Services Dept.
- Central Lake Ontario Conservation Authority
- Ministry of the Environment
COMMENT:
The Town of Newcastle Official Plan (Section 9.3 viii) states that new
residential lots in Hamlets shall generally be 0.4 hectares in area.
However, the Official Plan (Section 9.11 ii) further states that if evidence
satisfactory to the Town and the Health Unit has been produced which
indicates that a reduction in the minimum lot area is warranted, Council may
approve such a reduction only so far as the minimum lot size is not reduced
to below 0.3 hectares.
Staff further note that the lands subject of the Hamlet Plan Amendment
application are zoned "Residential Hamlet (RH)" by By-law 84-63. The
minimum lot area and frontage requirements of the "RH" zone are 0.3 hectares
and 30 metres respectively. The applicant's lot is 0.72 hectares in area
and has a frontage of 70.8 metres. The lot could be severed into two (2)
lots in conformity with the "RH" zone provisions. As well, the average size
of lots in the subdivision would be 0.43 hectares after the proposed
severance, thereby also complying with the Official Plan requirements.
Staff note however that the two (2) new lots would be smaller in area than
all but two (2) of the existing lots in the subdivision.

Inasmuch as the subject lot is part of a registered plan of subdivision for
which a Subdivision Agreement has been registered, any newly created lot
should be required to comply with the provisions of the Agreement in respect
of such matters as the issuance of a building permit, occupancy of dwelling,
architectural control, and lot grading. These requirements will be imposed
as Conditions of Approval of the related Land Division application.
Staff note that, although a number of comments from circulated agencies
remain outstanding, the purpose of the amendment is to change the maximum
number of lots within this area of the hamlet by one (1). If a problem is
identified which can not be overcome, Council can withhold final approval of
the Hamlet Plan Amendment. In the meantime, Staff feel it would be
appropriate to forward the draft amendment to Regional Council pursuant to
the requirements of the Durham Regional Official Plan. Upon receipt of all
outstanding comments and Regional Council's position, a subsequent report,
in respect of final approval, will be submitted for Council's consideration.

AMENDMENT N0. 4 TO THE HAMLET DEVELOPMENT PLAN
FUR THE HAMLET OF ENNISKILLEN
PURPOSE OF AMENDMENT
The purpose of Amendment No. 4 to the Hamlet Development Plan for the Hamlet
of Enniskillen is to increase the maximum number of permitted lots within the
southeast quadrant of the Hamlet from "22" to "23".
BASIS OF AMENDMENT
This amendment to the Hamlet Development Plan for the Hamlet of Enniskillen
is based upon an application submitted to the Town of Newcastle to amend the
Plan to permit the development of one (1) additional residential lot within
Registered Plan of Subdivision lOM-775.
ACTUAL AMENDMENT
1. Schedule "1" to the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by changing from "22" to "23" the maximum
number of residential lots permitted in the southeast quadrant of the
Hamlet and by deleting the conceptual road pattern in the southeast
quadrant, as shown on the attached Schedule "X" hereto.
2. Schedule "X" hereto shall form part of this Amendment.
IMPLEMENTATION
The provisions set forth in the Town of Newcastle Official Plan regarding the
implementation of the Plan shall apply in regard to this Amendment.
INTERPRETATION
The provisions set forth in the Town of Newcastle Official Plan regarding the
interpretation of the Plan shall apply in regard to this Amendment.

AMENDMENT NO. 4 TO THE HANILET DEVELOPMENT PLAN
FUR THE HAMLET OF ENNISKILLEN
PURPOSE OF AMENDMENT
The purpose of Amendment No. 4 to the Hamlet Development Plan for the Hamlet
of Enniskillen is to increase the maximum number of permitted lots within the
southeast quadrant of the Hamlet from "22" to "23".
BASIS OF AMENDMENT
This amendment to the Hamlet Development Plan for the Hamlet of Enniskillen
is based upon an application submitted to the Town of Newcastle to amend the
Plan to permit the development of one (1) additional residential lot within
Registered Plan of Subdivision 10M-775.
ACTUAL ANIENUMENT
1. Schedule "1" to the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by changing from "22" to "23" the maximum
number of residential lots permitted in the southeast quadrant of the
Hamlet and by deleting the conceptual road pattern in the southeast
quadrant, as shown on the attached Schedule "X" hereto.
2. Schedule "X" hereto shall form part of this Amendment.
