Minutes of the Committee of Adjustment

Preliminary Note
In response to the Province's Emergency Order and to maintain physical distancing
during the COVID-19 pandemic, this Committee of Adjustment meeting took place in an
electronic format. Members listed as being "electronically present," as well as applicants
and members of the public, participated though the teleconferencing platform Microsoft
Teams, which allows participation through a computer's video and audio, or by
telephone.

Chairperson, Todd Taylor called the meeting to order at 7:00 pm.

3. Applications:
3.1 A2020-0051 Owner/applicant: Alan Johansen
11 Church Street, Bowmanville
Alan Johansen, the applicant and owner of the property, participated via the Teams app
with audio. He gave a verbal presentation to the Committee in favour of the application.
Committee Member, Shelley Pohjola, asked Mr. Johansen if he had seen a copy of the
staff report recommending tabling the application.
Mr. Johansen replied that he had not, however had no objections to the
recommendation to table the application.
No other Committee Members had questions or comments.
No other persons spoke in support or opposition of the application.
Motion to table as recommended moved by Dave Eastman, seconded by John Bate.
Full text of decision:
"That application A2020-0051 for a minor variance to Section 12.2 d. i) of Zoning By-law
84-63 to reduce the front yard setback from the minimum required 4.5 metres to 4.1
metres to the dwelling be tabled for a period of up to thirty (30) days, to allow the
applicant more time to meet the Entrance Permit requirements of the Infrastructure
Division of the Public Works Department

3.2 A2020-0052 Owner/applicant: Antonio & Jennifer Megan Raso
1840 Nash Road, Courtice
Kuok-Kai Hong, the agent for the application, participated via the Teams app with audio.
He gave a verbal presentation to the Committee in favour of the application. Mr. Hong's
presentation provided similar arguments and details as provided in the recommendation
report prepared for this application.
Committee Member, Dave Eastman, asked staff for clarification on the missing page
four from the Land Division Application, which was submitted as part of the minor
variance application and asked if Regional Health had any concerns with the proposal.
Planning Staff Member, Toni Rubino, replied that the missing page four of the Land
Division Application must have been an error when the applicant submitted the
application and that for the minor variance application Regional Health had no
concerns.

No other Committee Members had questions or comments.
No other persons spoke in support or opposition of the application.
Motion to approve as recommended moved by Noel Gamble, seconded by Gord
Wallace.
Full text of decision:
"That application A2020-0052 for a minor variances to Section 9.2 b. to recognize the
existing lot frontage of 25 metres, whereas the Zoning By-law requires 30 metres and to
Section 9.2 a. to reduce the lot area from 4,000 square metres to 880 square metres be
approved as it is minor in nature, desirable for the appropriate development or use of
the land and maintains the general intent and purpose of the Zoning By-law, the
Durham Region Official Plan and Clarington Official Plan."

3.3 A2020-0053 & A2020-0054 Agent: David Pearce
Owner/Applicant: Michael Gimblett
2128 Regional Road 18, Newtonville
David Pearce, the agent, participated via the Teams app with audio. He gave a verbal
presentation to the Committee in favour of the application. Mr. Pearce's presentation
provided similar arguments and details as provided in the recommendation report
prepared for this application.
Michael Gimblett, the owner, thanked Clarington staff with their co-operation in
satisfying Land Division conditions.
No Committee Members had questions or comments.
No other persons spoke in support or opposition of the application
Motion to approve as recommended moved by Shelley Pohjola, seconded by Dave
Eastman
Full text of decision:
"That application A2020-0053 and A2020-0054 to reduce the minimum required lot
frontage for the severed and retained parcels from 30 metres to 10 metres to facilitate a
severance be approved as it is minor in nature, desirable for the appropriate
development or use of the land and maintains the general intent and purpose of the
Zoning By-law, the Durham Region Official Plan and Clarington Official Plan."

3.4 A2020-0055 Agent: Top Floor Design
Owner/Applicant: Perry Jackman - Hollee Homes Inc.
3 Pine Street, Bowmanville
Committee Member, Todd Taylor, asked the agent if she had seen the staff report.
Bobbi Ann Brooks, on behalf of Top Floor Design, participated via the Teams app with
audio. She indicated that she had seen the staff report and was not happy. She gave a
verbal presentation to the Committee indicating that the proposal was minor in nature.
Ms. Brooks added that the process was taking a very long time and that the initial two -
week hold up on the application has turned into 60 days.
Committee Member, Dave Eastman, clarified that the staff report indicated that the
recommendation was to table the application for up to 60 days, not a definite 60 days.
Planning Staff Member, Toni Rubino, replied that this was correct, and the application
could be tabled for up to 60 days and that the applicant did have a scheduled meeting
to review the proposal with senior Planning Department staff the week of November
16th
Chris Vesters, a local resident, spoke in opposition of the application. He noted that the
dwelling at 112 Duke Street is very large and there is very little land left to build on for 3
Pine Street, particularly for a semi-detached building. Mr. Vesters indicated that the
only comparable property in the neighbourhood is a duplex located at 7 Ann Street and
that 3 Pine Street is two-thirds the size of 7 Ann Street.
Staff member, Toni Rubino, provided an overview of the requested variances.
No other Committee Members had questions or comments.

Motion to table as recommended moved by Dave Eastman, seconded by John Bate.
Full text of decision:
"That application A2020-0055 for a minor variance to Sections 12.2 a. ii)., 12.2.1. b. ii)
c)., c. ii). b., d. ii) of Zoning By-law 84-63 to permit an increase to the maximum lot
coverage from 30% to 36%, to reduce the lot area from the minimum 550 square metres
to 540 square metres, to reduce the side yard setback from the required 1.8 metres to
1.5 metres and to reduce the minimum landscaped open space in the front yard (soft
landscaping) from the required 50% to 47% to facilitate the development of a semi-
detached dwelling at 3 Pine Street Bowmanville be tabled for a period of up to 60 days,
to allow the applicant time to adjust the building design to meet Public Works and
Planning staff comments."

4. Other Business:
Appeal date for the foregoing applications is December 2, 2020.
Next Meeting of the Committee of Adjustment is November 26, 2020.
