HomeMy WebLinkAbout99-121 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NO. 99- 121 Being a by-law to stop-up and close a portion of Gaud Gate and terminate the intersection at Regional Road 57; to establish a one foot reserve; and to divert a portion of Old Scugog Road and the intersection of Old Scugog Road and Regional Road 57 WHEREAS Council granted draft plan approval for DEV 87-88 (18T-87076), with conditions, on July 27, 1992; WHEREAS Council, at its meeting of February 9, 1998, passed Resolution GPA-83-98; that the proposed intersection construction at Old Scugog Road and Regional Road 57, as modified by the Region, be deemed as satisfactory to meet the conditions of Draft Plan approval as set out in Conditions 17, 18 and 19 in Report PD-283-89, submitted on November 6, 1989; WHEREAS Council, at its meeting of June 21, 1999, passed Resolution #GPA-344-99 which authorized the advertisement of a Public Hearing, as required by the Municipal Act, to stop up and close a portion of Gaud Gate and terminate the intersection with Regional Road 57; to establish a one foot reserve being Part 1, Plan 40R19060; and to divert a portion of Old Scugog Road and the intersection of Old Scugog Road at Regional Road 57, approximately 55 metres (177 feet) north of the existing intersection; WHEREAS the notice of the Public Meeting to be held by Council to consider this by-law was advertised in the local newspaper on June 23, 30 and July 7, 14, 1999; WHEREAS notice of Council's intention was sent to the Regional Municipality of Durham by Registered Mail on June 30, 1999 and approval was received by the Municipal Clerk by Registered Mail on July 14, 1999; NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON that a portion of Gaud Gate be stopped up and closed and the intersection terminated with Regional Road 57; that a 0.3 metre (1 foot) reserve be established; and that a portion of Old Scugog Road and the intersection of Old Scugog Road at Regional Road 57 be diverted 55 metres (177 feet) north of the existing intersection.
