By-Law No. 99- 142
Being of By-Law to establish Reserve
Funds for Development Charges—Imposed
by By-Law No. 125 and to Repeal
By-Law No. 99-126
WHEREAS the Council of The Corporation of the Municipality of Clarington passed By-
Law No. 99-125 to impose development charges under the Development Charges Act,
197, S.O. 1997, c.27;
AND WHEREAS under Section 34 of the Development Charges Act, 1997 the
Municipality is required to establish a separate reserve fund for each service to which the
development charge relates;
AND WHEREAS Council passed By-Law No. 99-126 to establish separate reserve funds
for the services to which the development charges relates;
AND WHEREAS Council considers it desirable to change the names of the reserve funds
established by By-Law No. 99-126 and expedient to repeal By-Law No. 99-126 and to
replace it with this By-Law.
NOW THEREFORE The Corporation of the Municipality of Clarington enacts as
follows:
1. THAT By-Law No. 99-126 is repealed.
2. THAT a reserve fund entitled"Development Charge—General Government"is
hereby established.
3. THAT a reserve fund entitled"Development Charge—Library Board"is hereby
established.
4. THAT a reserve fund entitled"Development Charge—Fire Department"is hereby
established.
5. THAT a reserve fund entitled 'Development Charge—Indoor Recreation" is
hereby established.
6. THAT a reserve fund entitled "Development Charge—Park and Development and
Facilities" is hereby established.
7. THAT a reserve fund entitled"Development Charge—Public Works Department"
is hereby established.
8. THAT a reserve fund entitled"Development Charge—Roads and Related"is
hereby established.
9. THAT a reserve fund entitled "Development Charge—Stormwater,Drainage and
Control Services" is hereby established.
10. THAT all development charges collected pursuant to the Development Charges
By-Law which identifies the quantum to be collected,be paid into the reserve
funds in accordance with the prevailing Development Charges By-Law:
11. THAT available balances remaining in the original development charges Reserve
Funds established under By-Law 92-93 be transferred into the appropriate new
development charges reserve funds.
12. THAT By-Law 92-96 (Development Charges—Municipal Purposes) and By-Law
92-94 (Development Charges—Hydro Electric Purposes)be repealed effective
September 1, 1999.
13. THAT this By-Law shall take effect on September 1, 1999.
By-Law read a first and second time this 27th day of September, 1999.
By-Law read a third time and finally passed this 27th day of September, 1999.
