HomeMy WebLinkAbout99-185 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 99- 185 being a By-law to authorize the entering into a Lease Agreement with Green Martin Properties Ltd. the Owners of Plan of Subdivision 18T-98004,who has an interest in the said lands and the Corporation of the Municipality of Clarington in respect of Block 3 within draft Plan of Subdivision 18T-98004. WHEREAS the Council on April 26, 1999, approved draft Plan of Subdivision 18T-98004 and authorized the execution of a Subdivision Agreement with the Owner; AND WHEREAS draft condition of approval number four(4) required the Owner to convey to the Municipality block 3 at the time of registration; AND WHEREAS draft condition of approval number four (4) further required the Owner to enter into a lease—back agreement for Block 3 on draft Plan 18T-89004 with the Municipality to include the payment of taxes and the construction of a facility suitable for a public use, for a period not to exceed ten(10)years from the date of registration of the subdivision. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal a Lease Agreement between Green Martin Properties Ltd. and said Corporation; and 2. THAT the Agreement attached hereto as Schedule"A"form part of this By-law. BY-LAW read a first time this 13th day of December 1999. BY-LAW read a second time this 13th day of December, 1999.
