BY-LAW 99-56
Being a by-law to expropriate certain lands in the Cove
Road and Cedar Crest Beach Road areas of the
Municipality of Clarington pursuant to subsection 191(1)
of the Municipal Act
WHEREAS at its meeting on March 8, 1999,the Council of the Corporation of the Municipality
of Clarington as approving authority under the Expropriations Act, R.S.O. 1990, c.E.26 approved
the expropriation of certain lands being Parts 1, 2, 5, 6, 7, 8, 10, 11 and 12 on Plan 40R-17895
for the purposes of reconstruction of the public and privately owned portions of Cove Road, the
construction of a bridge over the Westside Creek and approaches to the bridge to connect Cove
Road with Cedar Crest Beach Road; and establishing Cove Road,the bridge and approaches as a
public highway;
AND WHEREAS the lands are required for the purposes of the Corporation as aforesaid;
AND WHEREAS this by-law is passed pursuant to subsection 191(1) of the Municipal Act,
R.S.O. 1990, c.M.45, as amended.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF CLARINGTON ENACTS AS FOLLOWS:
1. THAT the Corporation of the Municipality of Clarington hereby expropriates the lands
being Part of Lots 10, 11, 12, 13 and Block D, Registered Plan 198; Part of Block"I",
Registered Plan 318 and Part of Lot 12, Broken Front Concession, Geographic Township
of Darlington in the Municipality of Clarington in the Regional Municipality of Durham
designated as Parts 1, 2, 5, 6, 7, 8, 101, 11 and 12 on plan of survey of record deposited
in the Land Registry Office for the Land Registry Division of Durham(No. 40) as Plan
40R-17895, for the purposes of reconstruction of the public and privately owned portions
of Cove Road,the construction of a bridge over the Westside Creek and approaches to
the bridge to connect Cove Road with Cedar Crest Beach Road; and establishing Cove
Road, the bridge and approaches as a public highway.
