BY-LAW 99-57
being a by-law to authorize the Mayor and Clerk on behalf
of the Municipality of Clarington to execute an expropriation
Plan in accordance with section 9 of the Expropriations Act
in respect of certain lands in the Cove Road and Cedar Crest
Beach Road areas of the Municipality of Clarington
WHEREAS at its meeting on March 8, 1999,the Council of the Municipality of Clarington
approved the recommendations contained in Report#SOL-1-99 and approved the expropriation
of Parts 1, 2, 5, 6, 7, 8, 10, 11 and 12 on Plan 40R-17895;
AND WHEREAS at the meeting on April 26, 1999, Council passed By-law No. 99-55 approving
the expropriation of the aforesaid lands;
AND WHEREAS at the meeting on April 26, 1999, Council also passed By-law No. 99-56
pursuant to subsection 191(1) of the Municipal Act, R.S.O. 1990, c.M.45, as amended to
expropriate the aforesaid lands.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF CLARINGTON ENACTS AS FOLLOWS:
1. THAT By-law No. 99-39 is hereby repealed.
2. THAT the Mayor and Clerk are hereby authorized on behalf of the Corporation of the
Municipality of Clarington as the expropriating authority to execute an expropriation plan
showing Parts 1, 2, 5, 6, 7, 8, 10, 11 and 12 on Plan 40R-17895, and to cause the
aforesaid plan to be registered in the proper land registry office pursuant to subsection
9(1) of the Expropriations Act.
