Res. # By-Law # ~~°' It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-52-87 be received; and 2. THAT Reports PD-20-87, PD-217-86 and PD-303-86 be lifted from the table and received for information; and 3. THAT the Region of Durham be advised that the Town of Newcastle recommends approval of the draft plan of Subdivision 18T-86018, dated November 13, 1986, as revised in red, subject to the revised conditions contained in Attachment No. 1 to this Report; and 4. THAT copies of Staff Reports PD-217-86, PD-303-86, PD-20-87 and PD-52-87 be forwarded to the Region of Durham; and * 5. THAT the attached by-law authorizing execution of a Subdivision Agreement between Kiddicorp Investments Limited and the Corporation of the Town of Newcastle be approved; and 6. THA1~ the Mayor and Clerk be authorized to execute the Subdivision Agreement between Kiddicorp Investments Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. ...2 ~~~ REPURT NO.: PD-52-87 Page 2 BACKGROUND AND COMMENT: At the request of Council, at its meeting of January 26, 1987, Staff have re-examined the issue of sidewalks and a walkway leading to Soper Creek Park. Staff Yiad recommended in Report PU-303-86, that a sidewalk be required on the south side of the cul-de-sac and a walkway be constructed to the park. As a result of a submission made by the applicant, to Council, both of these requirements were deleted. Report PD-20-87 was brought forward showing this revision. As a result of public submissions to Council members, Staff were requested to review the situation and report back to Committee. Planning Staff are still of the opinion that a sidewalk and walkway are warranted and have revised the Conditions of Approval to include negotiation of cost sharing for such a connection either along Simpson Avenue or along the south side of the cul-de-sac with a walkway to the park. As suggested, an alternative would be the construction of a side,~ra.lk south of Simpson Avenue to the park entrance. Staff respectfully recommend approval of the draft plan of subdivision, as revised in red on the attached plan, and subject 'to the conditions contained in Attachment No. 1 to this Report. That this approval shall apply to a draft Plan of Subdivision 18T-86018, dated January 13, 1986, as revised in red, prepared by H.F. Grandler for Kiddicorp Investments Limited, showing twelve (12) lots for semi-detached dwellings and an area which is not to be developed due to Fill Line constraints. 2. That the developer enter into a Subdivision Agreement with the Town of Newcastle. 3. That the Owner grant to the Town, free and clear of all encumbrances, all easements, road widenings and reserves, and dedications as requested. 4. That the Owner agrees to pay to the Town of Newcastle, the cash value of the five percent (5%) parkland dedication in lieu of parkland. 5. That the Owner agrees to dedicate the lands shown as Blocks 17 and 18 as Open Space at no cost to the municipality. 6. That the works be designed and constructed in accordance with the 1 atest Town of Newcastle Design Cri teri a and Standards, and shat 1 meet all the requirements of the Public Works Department, financial or otherwise. 7. That the road allowances included in this draft plan be dedicated as public highways. 8. That the road widening (Block 16 ), sight triangles and one 0.3 rvietre Reserves (Blocks 14, 15) be dedicated to the Town. 9. That the road allowances in the plan be named to the satisfaction of the Town of Newcastle and the Regional Municipality of Durham. 10. That the Owner agrees to satisfy all other requirements of the Town of Newcastle, financial or otherwise. This shall include, among other matters, execution of a Subdivision Agreement between the Owner and the Town concerning the provision and installation of roads, services, drainage etc. 11. That the developer will bear the costs (100%) of any works on Simpson Avenue which are necessitated as a result of this development, to the satisfaction of the Director of Public Works. 12. That the utility distribution on the cul-de-sac (Hydro, Bell, Cable TV, etc.) be installed underground (primary and secondary services). ...2 ~~~ Page 2 ATTACHMENT NO. 1 TU REPORT PD-52-87 TOWN OF NEWCASTLE CONDITIONS OF DRAFT APPROVAL SUBDIVISION APPLICATION 18T-86018 13. That the developer contributes to the costs of reconstructing Simpson Avenue in accordance with Town Policy. 14. That the developer be required to provide street lighting at Simpson Avenue and on the proposed cul-de-sac. 15. That the Owner enter into a Development Agreement with the Town of Newcastle, and the Public Works Department be kept informed of the status of all times. 16. That the Owner design the storm drainage and sanitary outfalls to the satisfaction of the Regional and Town of Newcastle Public Works Departments, the Department of Recreation, the Ministry of Natural Resources and the Central Lake Ontario Conservation Authority. The location and width of the outfall (Block 13) must be to the satisfaction of the Regional and Town of Newcastle Public Works Departments and the Department of Community Services. 17. That the Owner agrees to negotiate a cost sharing agreement for construction of a walkway to Soper Creek Park, the location being to the satisfaction of the Regional and Newcastle Public Works Departments and the Newcastle Community Services Department. This walkway shall be constructed. to Town standards and shall be approved. by the Newcastle Public Works Department. 18. That the developer be required to construct 1.5 metre sidewalks along the frontage of Lot 1, the flank of Lot 12, along the south side of the cut-de-sac, and to pay 100% of the cost of a connecting link to the existing sidewalk on the east side of Simpson Avenue to the north of the cul-de-sac. 19. That the Owner agrees to satisfy all the requirements of the Ministry of Natural Resources. 20. That the Owner agrees to satisfy all the requirements of the Central Lake Ontario Conservation Authority. 21. No grading or filling shall occur on the site without the written approval of the Central Lake Ontario Conservation Authori ty (C.L.U.C.A.). 22. Prior to the commencement of site preparation, including the rough grading of the access road, the Owner shall submit to the C.L.O.C.A. for approval, details of sedimentation control to be used throughout the development phase. ...3 ~(h, Page 3 ATTACHMENT NO. 1 TU REPORT PD-52-87 TOWN OF NEWCASTLE CONDITIONS OF DRAFT APPROV AL SUBDIVISION APPLICATION 18T-86018 23. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, an Agreement between Kiddicorp Investments Ltd. and the said Corporation dated the day of 1987, in the form attached hereto as Schedule "X". 2. THAT Schedule "X" attached hereto forms part of this by-law.
