RECOPRI+IENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-38-87 be received; and
2. THAT the By-law attached to Report PD-28-87 be replaced with the By-law and
Schedule attached hereto.
BACKGROUND AND CUi~N1ENT:
After review of the results of the General Purpose and Administration Committee meeting of
January 19, 1987, Staff has elected to change the zoning of a part of the subject lands.
The change does not alter the intent of the proposed amendment.
By-law 82-109 was the By-law which originally designated this site for the One Hundred and
Seventeen (117) unit apartment building. That By-law did not incorporate the
"Environmental Protection (EP)" zoning. This was added by By-law 84-63. Staff had
approved parking in what is now the "Environmental Protection (EP)" zone and the revised
plans maintain parking in this area. The General Amendments would have recognized this as
a permitted use.

There i s a possi bi 1 i ty that an appeal may be forthcomi ng regarding the
parking in the "EP" zone. Considering the Central Lake Ontario Conservation
Authority and Staff have approved the location of this parking since 1982,
Staff wishes to incorporate a change to the "Environmental Protection (EP)"
zoning to an existing zoning category which permits parking in the "EP"
zone, namely an "EP-2" zone. The By-law has been amended and a Schedule

attached, to reflect this change.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of tine Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 15.4.4(a) is hereby amended by changed from "Dwelling
Units (maximum) 117" to "Dwelling Units (maximum) 121"
2. Section 15.4.4(d)(iii) is hereby amended by changing from
"Exterior Sideyard 50 metres" to "Exterior Side Yard 8 metres".
3. Section 15.4.4(h) is hereby amended by changing from "1 having
a minimum area of 35 metres" to "1 having a minimum area of 35 square
metres".
4. Schedule "3" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Environmental
Protection (EP )" to "Environmental Protection Exception (EP-2)" as
shown on the attached Schedule "X" hereto.
5. This By-law shall come into effect on the date of passing
hereof, sub,~ect to the provisions of Section 34 of the Planning Act.
