RECOP~ENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-41-87 be received; and
* 2. THAT the attached by-laws to amend By-law 84-63, as amended, be forwarded to
Council for approval.
BACKGROUND AND COMMENT:
Two specific amendments to By-law 84-63, as amended, were deleted from the Report which
was presented to the General Purpose and Administration Committee meeting on January 19,
1987. These two changes are the subject of this report.
Staff has prepared a Schedule for Enfield and wishes to have the Schedule included in the
By-law. There was a request from the General Purpose and Administration Committee that
Staff review this change to determine if two specific lots should be included in the
"Residential Hamlet (RH)" zone. Staff has reviewed both requests and is of the opinion
that neither should be included in this zone.

The first of the lots (Knox) was created through a severance, and was
granted as afarm-related severance. Staff is of the opinion that this
entire area to the north of Concession Road 9 is more appropriately
maintained as "Agricultural Exception (A-1)".
The second lot is located in Part of Lot 29, Concession 8, east of the
Hamlet designation and is well outside of the area considered by Staff as
being a part of the Hamlet. Staff reviewed this site (Heard) and found that
it is currently zoned as "Environmental Protction (EP)" and "Agricultural
(A)". There appears to be no justification to extend the Hamlet into this
area.
After review of the situation, Staff has not altered the proposal for the
designation of the Hamlet. The By-law and Schedules are attached hereto for
Committee's approval.
As per Council's request, Staff has prepared a separate by-law which
proposes the deletion of home occupations as permitted uses within the
"Residential Estate (RE )" zone. This By-law is attached to this Report.

BY-LAW 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town of
Newcastle;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of
Newcastle enacts as follows:
1) Section 8.1(a) is hereby amended by deleting, in its entirety, Subsection
ii).
2) This By-law shall come into effect on the date of passing hereof subject
to the provisions of Section 34 of the Planning Act, 1983.

Newcastle enacts as follows:
1) Schedule "1" to By-law 84-63, as amended, is hereby further amended by
adding thereto, the notation "See Schedule 19 (Enfield)" to the lands so
identified on that attached Schedule "X-1" hereto.
2) By-law 84-63, as amended, is hereby further amended by adding thereto a
new Schedule 19 as shown on the attached Schedule "X-3" hereto.
3) This By-law shall come into effect on the date of passing hereof subject
to the provisions of Section 34 of the Planning Act, 1983.
