SUBJECT:
REQUEST BY MR. LORNE BUTTERFIELD FOR PERMISSION TO
OCCUPY AND RETAIN AN EXISTING DWELLING UNIT, AND
CONSTRUCT A NEW RESIDENCE ON THE SAME PROPERTY
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose & Administration Committee
recommend to Council the following:
1. That Clerk's Report CD-25-87 be received; and
2. That the Mayor and Clerk be authorized to execute an agreement with Lorne
Butterfield establishing the conditions under which building permit approvals
are granted; and
3. That a by-law be passed authorizing the execution of the agreement; and
4. That Mr. Butterfield be advised of the decision.
BACKGROUND AND COMMENT:
Mr. Lorne Butterfield, 33 Kimbermount Drive, Agincourt, Ontario, M1T 2Y1, has by
letter dated March 24, 1987, requested that the municipality authorize an agreement
which would permit him to build a new single family dwelling on his property,
located in Part Lot 6, Concession 8, former Township of Darlington, while at the
same time not requiring him to demolish the existing storage shed and second
storey apartment.
The applicant purchased the land (50 acres) in 1978, for the purpose of establishing
his retirement home there.

The dilema now facing Mr. Butterfield and one which must have Council's concurrence
is this:
1. Mr. Butterfield applied fora building permit to construct his retirement home
on the property;
2. The application was denied because the zoning by-law permits only one residence
to be located on the parcel; (a residence exists above the storage shed);
3. To overcome the problem, Mr. Butterfield requires Council's approval of an
agreement which will permit the construction of a new residence on the
property, without the necessity of demolishing the apartment located above
the storage shed;
4. The agreement in registerable form would contain conditions which would ensure
that the apartment would cease to be occupied upon completion of the new
residence and further, that the entire structure would immediately revert to
a use ancilliary to the orchard operation.
If this exception is approved, the Planning Department will.be prepared
to issue the necessary building permits.
A draft agreement setting out the conditions to be attached to the issuing of a
building permit in registerable form is attached for Committee's review.
