SUBJECT: REPORT ON ILLEGAL USE AND CONVERSION OF SEMI-DETACHED HOMES
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the fol1owing:_
1. THAT Report CD-37-87 be received for information
BACKGROUND AND COMMENT
Council, at the meeting of April 13th 1987 received the correspondence from Mrs. R. Breen,
51 Hartsford Drive advising that a number of dwelling units in the area had been, or were
in the process of being converted into apartments. The correspondence was referred to
the Clerk's Department and the Planning Department for review and a report to the General
Purpose and Administration Committee. (C-373-87).
Investigations undertaken by members of both departments have established that conversions
have occurred. Steps are now being taken to correct the problem. Because the actions
proposed include the laying of charges under the Ontario Building Code Act, and the
Town of Newcastle's Zoning By-law, it would be inappropriate to make further comment with
respect to the matter at this time. Members of Committee will be advised of the outcome
of Staff's actions.

MEMORANDUM

SUBJECT; Conversion of Single Family Dwelling

At approximately 11:10 a.m. this date, I attended the property located at 60 Hartsfield
Drive, Courtice, (Regis tered Plan #787, Lot 81, left) and was admitted to the dwelling
by one Tracy Donnelly, occupant.
Once inside, I observed what appeared to be two separate dwellings, the upper unit being
barred from view by a closed wooden door containing a locking device. Ms. Donnelly had
apparently come from the downstairs, through an identical door, now open. This door
also contained a locking device.
Ms, ponnelly informed me that the owner of the dwelling, one Antonelle Weissbok, occupied
the upstairs but was presently unavailable. She was kind enough to allow me to inspect
the downstairs ,which consists of a kitchenette (containing.a refrigerator and sink),
dining and living rooms, bedroom and bathroom. This unit did not, however, contain
cooking facilities (stove) nor di,d there exist an outlet for same. Ms. Donnelly informed
me that all hot meals were prepared upstairs..
The absence of cooking facilities notwithstanding, Terry, I personally believe that the
phrase "Single Housekeeping Unit" hardly applies to this property, given its present
state. Further to this, Mr. Greg Powless, Building Inspector, visited i;he property on
Tuesday, May 19, 1987, and has some difficulty as it relates to the Building Code. If you
feel that a Zoning prosecution should be initiated, perhaps it could be undertaken in
conjunction with whatever Building matters Greg chooses to further.

REPORT ON ILLEGAL USE AND CONVERSION OF SEMI-DETACHED HOMES
Further to our recent discussions, the following is an outline of
the events which have occurred relative to known conversions in
the Courtice area.
Within Registered Plan 787, there are a total of four (4) units
which are suspected of having being converted or are in the
process of being converted for basement apartments contrary to
the provisions of the Ontario Building Code and the Town's Zoning
By-law. Both the left and right halves of Lot 81, owned by
George Steeves of Hampton, were inspected on March 12, 1987 at
which time unauthorized work was found in the basement including
installation of plumbing and partitioning. The home owner was
advised th7at building permits would be required for the work. On
April 8, 1987 an Order to Comply was issued by the Building
Department inasmuch as work was continuing to progress. The
Order was issued to Mr. George Steeves.
It is not readily apparent, at this point in time, whether the
intentions of Mr. Steeves is to create abasement apartment or a
boarding/rooming house inasmuch as access has not been granted
for further inspection.
Similarly, on the left and right halves of Lot 83, owned by Mr.
R. Davies of Whitby, an inspection on March 12, 1987 revealed
unauthorized building activity in the basement and on the main
floor. Similarly, the left side of the semi-detached unit was
inspected on March 26, 1987 and similar unauthorized work was
identified.
On April 8, 1987, an Order to Comply was issued by the Building
Division as well as a Stop Work Order. On April 10, 1987 the
Orders were re-posted by the Building Inspector after having been
torn down. On that occasion, Mr. Brian Irwin was present and the
left half of Lot 83, having been occupied with the right half not
yet occupied.
On April 23, 1987 the Orders were reposted for the third time
after, again, being torn down. At this point i n time, the right
half of Lot 83 was a1 so occupied. Both tenants have inquired
about the legality of the apartment units and were advised to

consult with their lawyers. Building Staff noted that keyed
entrance sets had been installed on both top and bottom doors in
the dwelling.
On April 24, 1987 we were advised by the tenant in the left half
of Lot 83 that the Orders had again been torn down. On April 25,
1987 the home owner, Mr. Ron Davies, submitted an application for
recreation room, however, an inspection to verify this intention
has not been carried out inasmuch as access has not yet been
obtained.
The home owner was advised at the same time to repost the Stop
Work Order as required by the Ontario Building Code and was
~ provided with copies of Section 5 and 24 of the Ontario Building
Act. Following same, the home owner's solicitor phoned to advise
that he had instructed his client to comply. As of April 27,
1987 the Orders had not yet been reposted.
