LEGAL SERVICES RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That Clerk's Report CD-13-87 be received for information; and 2. That the local solicitor be thanked for his interest. BACKGROUND AND COMMENT: In September 1986, a local solicitor submitted a letter indicating an interest in providing legal services to the Town of Newcastle. Council directed that staff meet with the solicitor, review the proposal and report back. A preliminary meeting was held on October 27th 1:986, attended by the solicitor, the Chief Administrative Officer, and the writer. The substance of the meeting was limited to a review of his municipal experience, the type of services he was prepared to provide, and the volume of work that he might be expected to handle. As well, fee structures were discussed (i.e. retainer and fee for service, fees only, retainer against which fees earned are charged, etc.). On November 13th 1986, we met with Mr. David Sims and Mr. John Brady, of Sims Brady and McInerney, the Town's Solicitors. The purpose of this meeting was to explore the logic of hiring legal work done locally and the advantages of such a process. As well, there was a discussion respecting delays in the processing of documents which had been a problem in the past. Continued ...../2 C~ Report CD-13-87 - 2 - March 2, 1987 ~l ~" 6 Mechanisms designed to improve legal service levels to the municipality were explored and, as a result a better understanding of our requirements was achieved. Legal services will be monitored over the next year and, should modifications be required, these can be implemented through Mr. Sim's office. Staff would, therefore, recommend that the present system not be altered at this time and that the local solicitor be thanked for his interest.
