REVIEW OF BILL 179 "AN ACT TO AMEND THE MUNICIPAL
ACT AND CERTAIN OTHER ACTS RELATED TO MUNICIPALITIES"
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. That Report CD-8-87 be received for information; and
2. That the Minister of Municipal Affairs be advised that the Council of the Town
of Newcastle support the amendments proposed in Bill 179.
BACKGROUND AND COMMENT:
The Provincial Government as part of its ongoing practice, has been reviewing, and
where appropriate re-drafting legislation to remove redundant or archaic sections and
eliminate conflicts. between various pieces of legislation. In addition to removing
redundancies and conflicts, Bill 179 proposes amendments to existing legislation
which may for example enhance the municipality's opportunity to enact by-laws
respecting matters of a purely local nature without the need of applying for
special legislation.
Bill 179 has attached to it "Explanatory Notes" which briefly state the purpose and
effect of each of the amendments proposed. I have reviewed the existing legislation
and measured the effect if any, upon the municipality of the proposed amendment.

PART I
Amendments to the Municipal Act
1. Paragraph 22 of Section 1 deletes an obsolete reference to biennial (2 year)
elections, and brings the Act into conformity with The Municipal Elections Act.
Paragraph 28 which defined an "unorganized territory" is repealed and redefined
for further clarification.
2. Subsection 30(1) and (2) are repealed. They defined the electing of a Mayor and
"Alderman." The new subsection 30(1) and (2) are the same, save that Council
may now designate the Councillors of the municipality to be "Councillors" rather
than "Aldermen", by local option (by-law enactment) except in the City of Toronto.
3. Section 48 repealed and, a new section 48 enacted which gives the Minister the
power to declare all seats vacant and order a new election to be held if a
municipal council is unable to hold a meeting or a subsequent meeting within 60
days of the meeting that was not held. The time period is now more clearly
defined and as well, the Minister must declare all of the seats vacant, rather
than those members of council who refuse to attend the meetings of council.
4. Section 59 is repealed. It dealt with the appointment of a member of council to
act as the head of council in the absence of the mayor.
5. Subsection 72(2) is repealed and a new subsection (2) is enacted which has the
effect of consolidating the authority to appoint an acting head of council. The
intent of Section 59 is contained within the new section 72(2).
6. Subsection 77(4) is repealed. In the past the Provincial Archivest could request
& that council deliver the originals of by-laws or minutes no longer in force to be
7. deposited with the Archivest's office. The new subsection defined under Section
78(a) makes it optional in that the Council "may" agree to the transfer and
authorizes :their transfer to the Archivest.
Where a municipality transfers its original documents to the Archivest, a copy
of such documents certified by the Clerk may be filed and used in any court or
tribunal. Further, a copy of the original documents in the possession of the
Archivest may also be filed and used before any court or tribunal. Section 78 (b)
(1) and (2) establishes this as a permitted practice.

8. Subsection 87(2) is repealed. The new subsection provides that a by-law
appointing a collector remains in force until repealed. The provision is
considered unnecessary in light of Sections 4 and 27 of the Interpretations
Act.
Rules of Construction
Section 4: The law shall be considered as always speaking and, where a
matter or thing is expressed in the present tense, it is to be applied
to the circumstances as they arise, so that effect may be given to
each Act and every part of it according to its true intent and
meaning.
Implied Provisions
Section 27: (This section contains fifteen (15) subsections)
The section establishes that: In every Act, unless the contrary
intention appears, has the power to enforce and carry out the role
and duties assigned to him.
"...(b) where power is given to a person, officer or functionary
to do or enforce the doing of an act or thing, all such powers shall
be understood to be also given as are necessary to enable the
person, officer or functionary to do or enforce the doing of the
act or thing."
What seems to be implied is that where a Tax Collector is appointed
by by-law, the by-law shall remain in force until a successor is
appointed and, The Interpretations Act provides the authority under
which the Collector carries out the duties of the office.
9. Subsection 98(5) is repealed and a new subsection re-enacted which clearly establishes
that costs may be awarded to a lawyer who is a salaried officer of the corporation
or local board and further that such costs are payable to the municipality or the
local board as the ..case may be.
10. Subsection 100(1) is repealed and the

11. Subsection 117 is amended by the enacting of a new subsection. Subsection (7)
establishes, that special Acts are not required. That is, the approval of the
Minister or the Ministry is no longer required "to amend any by-law of a
municipality related to any approved pension plan.
Until now, the approval of such a by-law required the passage of special
legislation before such a by-law could be enacted by Council.
12. Section 120 is repealed. This section dealt with the establishing of a cold
storage business with, or upon the market property of the corporation. Section
208 paragraph 58 re-enacts section 120 and enacts paragraph 58(a) which deals
with the establishing of a cold storage business. Paragraph 58 is re-enacted
and has deleted the requirement that an agreement with Her Majesty the Queen
in Right of Ontario respecting regional economic development requires the
approval of the Minister.
13. Subsection 126(3) is amended by deleting the phrase "without the assent of
electors." The phrase is no longer relevant as it relates to the issuing of
debentures.
14. Section 127 which relates to the procedures to be followed by County Council
before issuing debentures on behalf of a local municipality and is now considered
unnecessary it is proposed that it be repealed.
15. Subsection 1'32(2) which relates to the publication of a proposed by-law requiring
the assent of the electors or is submitted to obtain their opinion is repealed.
Subsection 132(2) is re-enacted and "instead of publishing a copy of the by-law,
the council may publish a synopsis of it."
16. Section 135 which provides that ballot papers for voting on a by-law shall be
in such form as may be prescribed under the Municipal Elections Act, is repealed.
17. Subsection 137(2) is repealed. This subsection deletes the numerous requirements
related to the publishing of a synopsis of a by-law that is being promulgated.
(definition = make known to the public, disseminate, proclaim). Subsection 137(2)
is re-enacted and will provide for the publishing of a synopsis of the by-law,
rather than the publication of a true copy.

18. Subsection 148(4) is amended by the striking out of the words "without the assent
of the electors but." This subsection relates to the issuing of debentures payable
in foreign currency other than Canada, Great Britain and the Unites States of
America. Debenturing of this type would still require the prior approval of
the Lieutenant Governor. The amendment deletes "unnecessary words."
19. Section 151 is repealed. The section dealt with the special power of counties
to borrow and is deemed to impose an unnecessary restriction on counties.
20. I Clause (b) of paragraph 46 of Section 208 is repealed. There will no
longer be the requirement that by-laws relating to municipal employee pensions
be approved by. tl~e Ministry.
II Paragraphs 48 and 49 of Section 208 are repealed. They limited the provision
of paid life hospital and medical insurance to employees and their families.
Paragraph > 48 is amended and now provides for the provision of services to
"employees or retired employees and for paying the whole of the cost."
Paragraph 49 authorizes the provision of health services insurance under
the Health Insurance Act and for the payment of fees attendant thereto in
whole or in part. A further clarification of persons entitled to consideration
now includes "retired employees."
III Paragraph 58 of Section 208 is repealed. This Section deals with the
requirement that the Minister'_s approval be obtained prior to entering into an
agreement with Her Majesty the Queen in The Right of Ontario, respecting
regional economic development. Paragraph 58 is re-enacted and the need for
Ministerial approval has been deleted.
21. I ~;~;".Section 210 of the Act is amended by the addition of clause 6a dealing with
the leashing of dogs and their control when off the owner's property. Also
clause 6e has been added which requires the removal forthwith of dog
excrement by the dog owner. This section does not apply to physically
handicapped.
(When the municipality's animal control by-law is reviewed later this year,
staff will recommend the inclusion of these clauses and will also define
control as being physically restrained)
II Paragraph 71 is repealed. It deals with the provision of forms for recording
and reporting various infectious diseases. The matter is dealt with in the
Health Protection and Promotion Act, 1983.

III Clause (d) of paragraph 125 of section 210 as amended by the Statutes of
Ontario, 1982, Chapter 24, Section 10 is repealed. The section deals with
illegal parking of a motor vehicle on private property. Clause (d) now
contains an amended recital of the authority with the addition of the
reference to the Ontario Statutes.
IV Paragraph 136 of section 210 is repealed. It deals with the hauling of
dead horses, offal, night soil and other offensive matter. The provision
is now considered archaic.
22. Subsections 211 (17) and (18) are repealed. They dealt with the enacting of
by-laws to regulate the hours of retail gasoline service stations. Subsection
211(17) is re-enacted in a revised form which eliminates the requirement that
by-laws related to the closing of retail gasoline service stations may only be
repealed if more than one-third of the occupiers of service stations are opposed
to the continuance of the by-law.
23. Paragraph 2 of Section 225 and Clause (a) of Paragraph 3 of Section 225 are
repealed. They deal with the protecting and regulating of booms or any stream
or river for the safekeeping of timber and the necessity of obtaining the consent
of the electors for the issuing of debentures for the operation of county farms.
Both are archaic and their continued existance is no longer required.
24. Subsection 225a (1) of the Act as enacted by the Statutes__of__Ontario_,..1.986,....Chapter
14, Section 1 is repealed. This section related to the limitation of power to
control the gypsy moth programs to counties. The subsection is re-enacted and
the authority for controlling the gypsy moth program expanded to include all
municipal governments. To further confirm and consolidate the authority, the
words "County" and "County's" have been removed from Subsection 225a (3), (5)
and (6) and the words "municipality" and "municipality's" substituted where
appropriate.
25. Section 253 is repealed. This section dealt with the provision of authority to
councils for the expending of funds for receptions for persons or events or
matters of national or international importance. Section 253 is re-enacted and
the intent of the new section is to extend the authority for the expending of
funds for receptions etc., to any person or event considered by council to be
of interest or importance. Reference to national or international interest is
removed.

26. Sections 262, 263, 266, subsection 270(1), 270(7), 274 and 275 are repealed and/or
to re-enacted in altered form. The sections relate to the jurisdiction and control by
32. county councils over county bridges and roads. The sections referred to are re-
enacted and generally delete the authority of county councils to erect bridges on
highways not part of a county road system and to provide the mechanism whereby
county councils with the consent of the local municipality may transfer their
jurisdiction over existing bridges that are not on a county road system back to
the local municipality having jurisdiction over the road system where the bridge
is located. Section 274 deletes the requirement that a county must upgrade a
township road upon assumption of jurisdiction.
33. Sections 298 (3), (6), (7) and (12) are repealed and/or re-enacted in altered
form. Section 316 (4) is also repealed and proposed for re-enactment as subsection
298 (15). The sections deal variously with the registration of by-laws relating to
road closings in Land Titles or Registry Act. The new subsection 298 (15) formerly
316 (4) locates the authority for the paying of the funds from the sale or lease
of stopped-up highways into a special account.
34. Section 309 is amended by the addition of Section 309a which authorizes
municipalities to construct noise abatement works on the untravelled portion of
any highway. Such works will be able to be undertaken as a local improvement
work by upper tier municipalities not local or lower tier municipalities.
35. Section 316 of the Act is repealed. This section dealt with the manner in which
original road allowances owned by the municipality deemed to be surplus could be
disposed of by the municipality. The section is re-enacted and revised and now
contains the provisions related to the sale of such lands now found in section 57
of the Surveys Act. The purpose here is to consolidate and provide all of the
pertinent authority within one section. The re-enacted section 316 will now
impose an obligation upon the municipality to offer to owners of lands abutting
either side of a stream, river or other body of navigable water an opportunity
to purchase a part of the road allowance on the same basis that a parcel of land
is currently offered for sale to abutting owners.
36. Section 325 is amended by the removal of the words "without obtaining the assent
of the electors." The words are unnecessary. The section deals with enforcing
performance of things required to be done under by-law and collecting the debt
incurred from the property owner in a like manner as taxes.

AMENDMENTS TO OTHER ACTS
The Local Improvement Act
37. I Subsection 2(1) of the Local Improvement Act is amended to provide for the
addition of paragraph (s) "constructing noise abatement works on the
untravelled portion of a street." The addition of this paragraph provides
the authority to establish such activities as a local improvement when
carried out pursuant to sections 309 and 309(a) of The Municipal Act.
II The proposed amendments to the Act also permit`: the municipality to pay
part of the cost of noise abatement works undertaken as a local improvement.
III The amendments also permit the upper tier municipality to assess the costs
against the owners of lands directly abutting the works and to provide for
the collection of the abutting owners share as a local improvement.
The Municipal Elections Act
38. Subsection 44(3) is amended by adding the words "or councillor" to the end of the
to last line. This amendment is complimentary to the enactment of subsection 39(9)
41. of The Municipal Act, which subsection identifies the various municipalities that
will be able to designate "aldermen" as "councillors."
42. Subsections 57(2) and (9) of The Surveys Act are repealed. They have been
re-enacted under Section 316 of The Municipal Act. Their relocation within the
Municipal Act will assist municipal staff in providing more accurate information
with respect to the disposal of surplus lands situate within plans of subdivisions.

The Ministry has within Bill 179, undertaken revisions which will be of benefit to all
municipalities in Ontario. There is nothing in the Bill which adversely affects the
Town of Newcastle and it may be appropriate to advise the Minister that the
municipality supports the amendments proposed in Bill 179.
It is therefore, recommended that this report be received for information.
