CD-1-85 - File: 35.23.10. SUBJECT: DISSEMINATION OF INFORMATION BY THE TOWN OF NEWCASTLE RESPECTING THE ADVANTAGES OF THE MUNICIPALITY AS AN INDUSTRIAL, AGRICULTURAL, BUSINESS, EDUCATIONAL RECREATIONAL OR VACATION CENTRE. • RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That this report be received; and 2. That the by-law attached to this report be recommended to Council for passage; and 3. That the Regional Municipality of Durham be advised of the actions taken by Council. BACKGROUND AND COMMENT: By letter dated February 22nd 1984, the Region of Durham advised the Town of Newcastle of the passage of a Regional By-law authorizing the Councils of area municipalities to disseminate information respecting the advantages of the municipality as an industrial, agricultural, business, educational, recreational or vacation centre. Council, at the meeting of March 12th 1984, referred the correspondence and attached authorizing by-law "to staff for review and a report." Concern- was expressed about the wording in the Regional By-law which granted authority to the area municipalities to disseminate information "without any terms or conditions", while at the same time, requiring the local municipality to "ensure that the programs and policies carried out are complementary to the programs and policies of the Regional Municipality of Durham." This apparent conflict was the subject of dialogue between the Administrator and Regional Staff, and it would appear that the clauses are not intended to be contradictory. It would seem, that the section referring to Regional Programs and Policids was included to make the area municipalities aware of the role that the Region plays in the industrial development field. • The Administrator requested that a by-law be prepared for Committee's consideration. If members of Committee find the by-law attached hereto to be in order and of sufficient detail for the Town's purposes, it is recommended that the by-law be forwarded to Council for passage and the Region advised of the actions taken. THE CORPORATION OF THE TONN OF NEWCASTLE BY-LAM 85- Deiny a by-lav to authorize the Council of the Torn of Nevwstle to disseminate information respecting the advantages of the Town of Newcastle as an industrial, business, educational, recreational or vacation centre WHEREAS Subsection 2a of Section 131 of the Regional Municipality of Durham Act, provides that the Regional Council may authorize, for such period and on such terms and conditions as the Regional Council considers desirable, the Council of an area municipality to exercise the powers conferred on the Council of a municipality by paragraph 22 of Section 208 of The Municipal Act. ANO NHEREAS the Regional Municipality of Durham did at its meeting of February 15th 1984, enact by-law 24-84 authorizing all of the area municipalities to exercise the powers contained in paragraph 22 of Section 208 of The Municipal Act without any terms or conditions. AND WHEREAS pa ragraDh 22 of Section 208 of the Municipal Act provides that by-laws may be passed by the Councils of all municipalities for providing for disseminating information respecting the advantages of the municipality as an industrial, agricultural, business, educational, residential, or vacation centre, anJ tlia[ the power conferred by this section may be exercised jointly by two or more municipalities. NUN THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY • ENACTS AS FOLLOMS: 1. That [he Council of the Corporation of the Town of Newcastle shall pursuant to paragraph 22 of Section 208 of The Municipal Act, disseminate infonna ti on respecting the advantages of the Town of rvewcast le as an industrial, agricultural, busrness, educational, residential or vacation centre; 2. That in exercising the powers conferred on the Council of the Town of Newcastle 6y paragraph 22 of Section 208 of The Municipal Act, the Council of the Town of Newcastle shall ensure that the programs and policies carried out pursuant to paragraph 22 of Section 208 of The Municipal Act, shall 6e complimentary to the programs and policies of the Regional Municipality of Durham. 6y-law reatl a first and second time this day of - 1985 • By-taw read a third time and finally passed this day of 1985 Clerk
