HomeMy WebLinkAbout2520A by-Law. to amend by-Law No. 2379 and provide for the sale of parts of the stopped up road allowance between lots 32 and 33 in the 3rd Concession of the Township of Darlington to the abutting owners. WHEREAS the Corporation of the Township of Darlington (hereinafter referred to as "the Township") did by By-Law No. 2379 passed on the 7th day of March, 1968 stop up and close those parts of the original road allowance between lots 32 and 33 in the 3rd Concession of the Township of Darlington more particularly described therein. AND WHEREAS the said By-Law No. 2379 was approved by the Corporation of the United Counties of Northumberland and Durham by its By-Law No. 2194 passed on the 24th day of July, 1968. AND WHEREAS the said By-Law No. 2379 provided for the sale of the said stopped up parts of original road allowance more particularly described in Schedules "A" and "B" therein set out to Michael W. Mayko and Audrey Marie Mayko and to Eldon Essery respectively as the adjoining owners but in fact the said Michael W. Mayko and Audrey Marie Mayko and Eldon Essery were not the adjacent owners to the said closed parts of the original road allowance described in Schedules "A" and "B". AND WHEREAS Michael W. Mayko and Audrey Marie Mayko, Eldon Essery and Daniel Skoretz and Elaine Skoretz, the owners of the lands lying immediately adjacent ~ the said closed parts of original road allowance have applied to the Township for conveyances of those parts thereof which they have in fact had fenced with their properties and to which they are entitled as shown on a plan of survey of Merrill D. Hown Limited dated April 15th, 1973 attached hereto as Schedule "A". NOW THEREFORE the Council of the Corporation of the Township of Darlington pursuant to The Municipal Act R.S.O. 1970 Chapter 284, Section 461 (1) HEREBY ENACTS as follows: 1. That paragraph three of By-Law 2379 be deleted and stricken out. - 2 - 2. That the following paragraph be substituted for the said paragraph three in By-Law No. 2379, "3. That the said parts of original Road Allowance hereby stopped up and closed shall be offered- for sale to the abutting owners as follows: (a) The northern 660 feet of that part of the closed original road allowance described in Schedule "A" to Michael W. Mayko and Audrey Marie Mayko or their successors in title at the price of $1.00. (b) The balance of that part of the closed original road allowance described in Schedule "A" and the west half of that part of the closed original road allowance described in Schedule "B" to Eldon Essery at the price of $1.00, (c) The east half of that part of the closed original road allowance described in Schedule "B" to Daniel Skoretz and Elaine Skoretz at the price of $1,00, 3. this this That a new paragraph five be added to By-Law No. 2378 as follows: "5. That the Reeve and Clerk are hereby authorized to sign and impress the municipal corporate seal on Quit Claim Deeds in favour of the said Eldon Essery and Daniel Skoretz and Elaine Skoretz covering their properties which have in fact included within their boundary fences the respective parts of the said closed road allowance to which they are entitled as abutting owners, and that such a Quit Claim Deed shall be a good and valid conveyance of the one- half of the said closed up part of road allowance to which Eldon Essery and Daniel Skoretz and Elaine Skoretz are respectively entitled."
