WHEREAS the Council of the Corporation of the
Township of Darlington deems it advisable to pass a by-law
'to close the original Road Allowance between the north halves
of Lots 26 and 27 in the 5th Concession of .the Township of
Darlington, .and to provide for the sale thereof to the abutting
owners.
AND WHEREAS Notice of such by-law was published
in the Canadian Statesman, a weekly newpaper published in the
Town of Bowmanville and circulated in the Township of Darlington,
;in its issues dated the 17th, 24th and 31st days of October and
;the 7th day of November, 1973.
AND WHEREAS Notice of such by-law was further
;published by posting up for atleast one month in six of the
most public places in the immediate: neighbourhood of the said
original road allowance.
AND WHEREAS no person or corporation will be
deprived of the means of ingress and egress to and from his
land or place of residence by the passing of this by-law.
NOW THEREFORE the Council of the Corporation of
'the Township of Darlington pursuant to the Municipal Act
R.S.O. 1970, Chapter 284, Section 443 (1) (c) and (d) and
:Section 461 (1) HEREBY ENACTS as follows:
1. That the said original Road Allowance lying between the
north halves of Lots 26 and 27 in the 5th Concession of
• the Township of Darlington, be and the same is hereby
closed and stopped up.
2. That the said original Road Allowance lying between the
north halves of Lots 26 and 27 in the 5th Concession of the
Township of Darlington hereby stopped-up and closed shall
be offered for sale to the abutting owners as follows:
(a) Harold Alan Pascoe, the north part thereof
described as Part 6 on Reference Plan

(b) Michael Vetzal, the south part thereof
more particularly described in Schedule
"A" hereto. containing 2.246 acres more
or less at the price of $ .7. 0 °iy,
3. That upon payment of the said purchase prices by the respective
abutting owners, .the Reeve and Clerk are hereby authorized
and directed to sign conveyances of the said stopped-up
parts of the original Road Allowance to the said owners
and impress the Corporate Seal thereon.

ALL AND SINGULAR that certain parcel or tract of lands and
premises situate, lying and being in the Township of Darlington
in the County of Durham and in the Province of Ontario as
being composed of that part of the original Road Allowance
between the north halves of Lots 26 and 27 in the 5th Concession
in the said Township of Darlington containing 2.246 acres
more or less and being more particularly described as follows:

COMMENCING at a point in the east limit of said Lot 27 distant
southerly therein on a course of south 17 degrees 57 minutes
20 seconds east 1,633.50 feet from the north-east angle of
said Lot,. said point of commencement being the south-east
angle of Part 7 on Reference Plan lOR 213 deposited in
the Registry Office for the Registry Division, of Durham
West (No. 10) on the 28th day of August, 1973;
THENCE North 72 degrees 14 minutes 40 seconds East in and along
a post and wire fence a distance of 34.06 feet to a fence
running southerly in the middle of the said original road
allowance;
THENCE South 18 degrees 03 minutes 50 seconds East in and
along the said post and wire fence marking the centre of the
original road allowance a distance of 331.77 feet to a point
in a post and wire fence running easterly;
THENCE North 71 degrees 24 minutes 20 seconds East a distance
of 31.31 feet to a point in the eastern limit of said original
road allowance lying between the north halves of Lots 26-and
27 in the S=hConcession and a point in the west limit of Lot 26
in the 5th Concession;
THENCE Southerly in and along the said eastern limit of the
original road allowance and the west limit of said Township
Lot 26 in the 5th Concession a distance of 1308.08 feet
more or less to a post and wire fence marking the half lot
line between the north and shs~l~es of the Said original
road allowance and the north alves of Lots 26 and 27 in the
5th Concession of the Township of Darlington;
THENCE Westerly across the said original road allowance in and
along the said half lot line between the north and south
halves of the said original road allowance a distance of 66
feet more or less to a point in the western limit of said
original road allowance and the eastern limit of Lot 27
in the 5th Concession in the Township of Darlington;
THENCE northerly in and along said western limit of the
original road allowance and the eastern limit of said lot 27
in the 5th Concession a distance of 1,639.95 feet more or
less to the POINT OF COMMENCEMENT.
