HomeMy WebLinkAbout2523A By-Law to stop and close the original Road Allowance line between Lots 34 and 35 in the 2nd Concession, in the Township of Darlington and to provide for the sale thereof to the abutting owners. WHEREAS the Council of the Corporation of the Township of Darlington deems it advisable to pass a by-law to close that part of the original Road Allowance lying between Lots 34 and 35 in the 2nd Concession of the Township of Darlington, more particularly described in Schedule "A" attached hereto. and to provide for the sale thereof to the abutting owners. AND WHEREAS Notice of such by-law was published in the Canadian Statesman, a weekly newspaper published in the Town of Bowmanville and circulated in the Township of Darlington, in its issues dated the 17th, 24th, and 31st days of October and the 7th day of November, 1973. AND WHEREAS Notice of such by-law was further published by posting up for atleast one month in six of the most public places in the immediate neighbourhood of the said original road allowance. AND WHEREAS no person or corporation will be deprived of the means of ingress and egress to and from his land or place of residence by the passing of this by-law. NOW THEREFORE the Council of the Corporation of the Township of Darlington pursuant to the Municipal Act R.S.O. 1970 Chapter 284, Section 443 (1) (c) and (d) and Section 461 (1) HEREBY ENACTS as follows: 1. That the said part of the said original Road Allowance between Lots 34 and 35 in the 2nd Concession of the Township of Darlington, and being more particularly described in Schedule "A" attached hereto, and shown as Parts 2, 3 and 4 on Reference Plan lOR 254 deposited on the 31st day of October, 1973 a copy of which is attached hereto as Schedule "B", be and the same is hereby closed and stopped up. - 2 - 2. That the said parts of original Road Allowance lying between Lots 34 and 35 in the 2nd Concession of the Township of Darlington hereby stopped up and closed shall be offered for sale to the abutting owners of the original Road Allowance as follows: (a) William Simon Clarence Penfound, Parts 2 and 3 on Reference Plan lOR 254 containing 1.64 acres at a $ ~J a0~~,~/~ price of •c (b) William Simon Clarence Penfound by assignment from Lorne Mason Penfound and Edna Jean Penfound, Part 4 on Reference Plan lOR 254 containing $ q 0 ~ ~~f,` 0.71 acres at a price of •C 3. That upon payment of the said purchase prices by William Simon Clarence Penfound, the Reeve and Clerk are hereby authorized and directed to sign conveyances of the said stopped up parts of the original Road Allowance to the said owners and impress the Corporate Seal thereon. That By-Law No. 2523 of the Corporation of the Tocmahip of Darlington, passed the 13th day of November, 1973, insofar as it relates to the stopping up and closing of the said road allowance, as outlined in Schedule "A" attached hereto, be and the same is hereby confirmed.
