NEi•10Rlu~TDUM OF AGREEMENT Schedule ~'A" To By-Law No, B E T Id E E Id THE CORPORATION OF THE TOhIDI OF BOWfit1NVILLE Hereinafter referred to as "The Tocm~' A h' D THE CORPORATION OF THE TOWNSHIP OF DARLINGTON Hereinafter referred to a~ "The Tovmship" WHEREAS it appears desirable that the services of the Staff and equipment of the Bowmanville Fire Brigade shall be available to the Township of Darlington on a shared cost basis; AND WHEREAS the Town and the Township have,. by their respective by-laws numbered7i'-/~ an~t7yr,3~, authorized the entering into and execution of this Agreement; NOW THEREFORE, in consideration of the premises ~.nd covenants hereinafter contained, the Town and the Tocroship HEREBY MUTUALLY AGREE AND COVENt1NT :;S FOLLOWS: i) The services of the Botmianville Fire Brigade shall be available to fight fires in the Township when called upon, except that the Fire Chief shall have the right to decide whet, if any, equipment shall answer any call, 2) The Township shall, annually, pay to the Tom, Fifty Per Cent of the cost of operation of the Boomianville Fire Department, and in any year in which the number of fires in the Township exceeds fifty per cent of the total, the Township shall pay to the Socan an additional amount in direct relation to the proportion of fires occurring in the Toi-m ship as opposed to those which occur in the Tovme 3} For the purposes of this agreement, costs incurred shall be as follows: a) Capital debt retirement including both principal and interest on acquisition of machinery equipment, buildings or other assets acquired by the Town for the use of the Fire Department over more than one year. In this connection, the present quarters at Church Street, Bowmanville, shall be assessable to the Fire Department at 25% of the total annual charges for the Building, b) Capital Expenditures out of current revenue, Capital Expenditures included in paragraph 3 (a) and 3 (b) shall be subject to approval of the Council's of the Town and the Township, c) Maintenance and overhead charges, ~. L d) Expenditures for supplies, tool^, and materials requires for the functional operation of the Department e) All such other costs and expenses which are incidental to and inherent in the operation of the Department and vrhich are of direct benefit to that Departrient 4) Costs which shall not be included are the following: a) Hydrant Rentals b) Street Fire Alarm System 5) Payment to the Tovm by the Tovmship shall be made in quarterly instalments, based on 50% of the actual expenditures during that quarter with a final statement at the end o~ each i`inancial year on the basis of the proportion as set out in Clause 2 of this Agreement. 6) The Town shall submit to the Township for approval, not Later than March 15th in each year, an esti~.~ate of the costs of operating the Fire Department, 7) The term of this Agreement shall be frori January 1, 19(9 to December 31, 1972, or such longer period as may be agreed upon by resolution of both Councils. B) Notvrithstanding the provisions of this Agreement, no liability shall accrue to the Tocatt by its inability to supply the services authorized herein.
