WHEREAS the aforementioned lands were conveyed from
Donald W. Lamb and Jennie Iola Lamb to Hans Dietrich Knecht andErika
Marli Knecht on the 22nd day of March, 1860, by instrument registered
in the Registry Office for the Registry Division of the West Riding of
the County of Durham as No. 11114.
AND WHEREAS the said conveyance was made pursuant to the
consent of the Planning Board of the Township of Darlington.
AND WHEREAS the consent of the Planning Board of the
Township of Darlington was given on the following condition: "That
Hans Dietrich Knecht and Erika Marli Knecht, the Grantees, irrevocalbl y
undertake and agree to grant part of said lands for the purpose of
improving of the given road adjacent thereto to the Township of
Darlington, provided that such parcel does not extend more than 25
feet in depth diagonally from the North-West angle of the parcel
being conveyed as determined by a survey by F.J. Donevan Associates,
dated Se~mber 1st, 1959 and further provided that no more land will
be taken than is reasonably required to effect the improving of the
curve".
AND WHEREAS the Township of Darlington is now desirous
of acquiring certain other lands presently owned by the said Hans
Dietrich Knecht and Erika Marli Knecht for road widening purposes.
NOW THEREFORE the Municipal Council of the Corporation of the Town-
ship of Darlington ENACTS AS FOLLOWS:
The Corporation of the Township of Darlington in con-
sideration of the acquisition of certain lands for road widening pur-
poses, namely, that part of Lot lg, Concession 6, of the said Township
of Darlington shown as Part 2 on R.D. Plan 46, copy of which is
annexed hereto, doth release unto the said Hans Dietrich Knecht and
Erika Marti Knecht, all its right, title and interest in part of Lot
lg, Concession 6, arising out of the condition attached to the con-
sent of the Planning Board of the Township of Darlington upon the
conveyance of the said lands to Hans Dietrich Knecht and Erika Marli
Knecht.
