CUMMINS PART LOT 30, CONCESSION 8, DARLINGTON OUR FILE: DEV 87-78 RECOMh1ENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the follovaing: 1. THAT Report PD-314-87 be received; and 2. THAT the application submitted by Mr. John Cummins, to rezone a 1.07 hectare parcel of land located in Part of Lot 30, Concession 8, former Township of Darlington to include the said lands within the "Residential Hamlet (RH)" zone, be tabled pending the applicant's submission of the necessary justification pursuant to Section 3.14 of the Foodland Guidelines in consideration of the request to expand the Hamlet boundary limits. BACKGROUND AND COMMENTS: On October 5, 1987 the Planning Department received an application submitted by Mr.. John R. Cummins to rezone a parcel of land within Part of Lot 30, Concession 8, former Township of Darlington, Hamlet of Enfield. The proposed rezoning would expand the limits of the "Residential Hamlet (RH)" zone to permit the development of two (2) additional residential lots. ...2 ~ Cc~ REPORT NO.: PD-314-87 PAGE 2 The subject lands are located within the vicinity of the "Hamlet" designation within the Region of Durham Official Plan and the Town of Newcastle Official Plan. The predominant use of lands within this designation shall be for residential development and shall be limited to minor internal infilling and/or minor additions to existing development. All development within a Hamlet shall comply with the Agricultural Code of Practice, as amended. Within the Town of Newcastle Zoning By-law 84-63, as amended, the subject property is currently zoned "Agricultural (A-1)". The predominant use is agricultural and farm-related uses. In accordance with approved policy, the subject application was circulated to various agencies and departments for comments. The following is a summary of comments which have been received. The following departments/agencies had no objections: - Central Lake Ontario Conservation Authority - Regional Health Unit - Newcastle Building Department The Newcastle Fire Department commented as follows: "The Fire Department has no objections.... Emergency fire response is from Station #4, which is outside of the recognized five mile limit and water supply for firefighting is by Fire Department tanker trucks." The Newcastle Public Works Department commented as follows: "l. That the owner contribute to the reconstruction of Concession Road 9 abutting the lands in question (+ 80.7 metres) 2. Based upon the information submitted, the Public Works Department may require a drainage easement to ensure positive roadside drainage through the existing natural watercourses or suitable lot grading plans showing the location of any proposed buildings." The Regional Planning Department indicated as follows: "The subject property is located in the vicinity of Enfield which is designated as a Hamlet in the Regional Official Plan and the Town of Newcastle Official Plan. In both Plans, residential development shall be limited to minor internal infilling and/or minor additions to existing development. The proposed use of the subject property therefore, may be permitted." ...3 V ~C/ REPORT NO.: PD-314°87 The Ministry of Agriculture and Food commented as follows: PAGE 3 "The application is to provide a small (1.07 hectare) addition to the Hamlet of Enfield. We note that the boundaries of the Hamlet were expanded in the Spring of 1987 and therefore, question the need for further expansion only a few months later. When an expansion of any urban area is proposed onto farmland, `the use must be justified as outlined in Section 3.14 of the Foodland Guidelines." It is noted for the Committee's information that Section 3.14 within the Foodland Guidelines requires that the need for the landuse for residential purposes must cover each of the four following basic issues: the necessity for the land use, the amount of land needed, the reasons for the choice of location, and the consideration given to alternate locations on lower capability agricultural land. The relevant provisions of Section 3.14 goes on to further expand the relevant criteria to be considered. The Ministry of Agriculture and Food has indicated that upon receipt of this information, a more detailed response would be provided. Staff would note that the applicant has been advised of the above comment and need for additional information. Inasmuch as the limits of "Residential Hamlet (RH)" zone within the Hamlet of Enfield has recently been approved, it is Staff's opinion that the applicant's submission of the above-noted information to support the rezoning application is warranted.
