THAT Report PD-276-87 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of October 8, 1987. This list includes the file number, applicant's name, site location, type of variance requested, Official Plan conformity, By-law conformity, Staff's comments on the applications, and the Committee of Adjustment's decision. Murdoch Member Bernhard Heming Member Arnold Reicheld Current Operations Planner Carlo Pellarin Secretary Carrol Clemens APPLICATIONS: A 73/87 - Patrick ~ Carol Murphy, Lot 11, Concession 2, Bowmanville Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to the existing single family dwelling leaving a 5.5 ft. side yard and maintaining an existing 14.6 ft. side yard, instead of the required, without an attached garage or carport, 4.5 m (14.76 ft.) on one side and 1.2 m (3.93 ft.) on the other. Carol Murphy appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Heming, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law or have a detrimental effect on the surrounding neighbourhood, this variance could be considered minor and therefore permission is GRANTED to construct an addition to the existing single family dwelling leaving a 5.5 ft. side yard and maintaining a 14.6 ft. side yard on the other side." Dennis Wheeler of J. D. Barnes, Surveyors appeared in support of this. application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch., seconded by Mr. Rehder, "THAT as the requested variance would appear to conform with the intent of the Official Plan and Zoning By-law and would not appear to have a detrimental effect on the surrounding properties acid, due to the shape of the lot, the side yard is only deficient at one cornef~ of the dwelling, the variance is considered minor in nature and permission is GRANTED to continue the construction of a single family dwelling, leaving a side yard of 1.00 m. This variance is conditional upon meeting the requirement of the Ontario Building Code with respect of unprotected openings on the exposed building face to the property line." Moved by Mr. Rehder, seconded by Mr. Murdoch, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law or have a detrimental effect on the surrounding properties and as the front yard setback is sufficient so as not to interfere with sight lines at the inter- section, the variance 'could be considered minor and permission is GRANTED to construct a single family dwelling leaving an exterior side yard of 4.5 m." (6.09 m), instead of the required not more than 5 m in height. Mr. & Mrs. McLean appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Reicheld, "THAT as the requested variance would not ,appear to offend the intent of the Official Plan or Zoning By-law or have an adverse effect on the surrounding properties and due to the size of the lot this variance is considered minor and permission is GRANTED to construct an accessory building having a height of 20 ft. (6.09 m): This variance is conditional that the loft is NOT USED as a habitable room." "CARRIED" A 78/87 -Daniel Lang. Lot 26, Concession B.F., Newcastle Village. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 865 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr. Lang appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Rehder, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law or have a detrimental effect on the surrounding properties and due to the size of the house with no basement a larger accessory building would be an asset, therefore the variance is considered minor and permission is GRANTED to construct a 865 sq. ft. accessory building."
