It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-234-87 be received; and
2. THAT the Bond Head Development Plan as amended, attached hereto as Attachment No. 2,
be forwarded to Council for approval; and
3. THAT By-law 87- to amend 6y-law 84-63, attached hereto as Attachr~ent No. 3, be
forwarded to Council for approval in accordance with Resolution #GPA-57G-87; and
4. THAT a copy of Council's decision be forwarded to f~1r. & h1rs. S. Staby, the Region of
Durham and the interested parties indicated hereto.
BACKGROUND AND COiV1i~lENT:
On July 6, 1987, Committee adopted Resolution #GPA-576-87 recommending to the Region of
Durham that the "f~~ajor Open Space" designation adjacent to Lake Ontario in Lot 27, B.F.C.,
former Township of Clarke, be amended to permit the severance of one additional lot from

the Staby property on the east side of Park Street. The resolution also
recommended that Rezoning Application DEV 86-61 submitted by the Stabys
be approved and the amending zoning by-law be forwarded to Council at
such time as the related Official Plan Amendment has been approved by the
Region of Durharn.
On September 1, 1987, Regional Planning Committee considered a Staff
Report in respect of the Staby application and approved Amendment No. 173
to the Regional Official Plan (see Attachment ado. 1). Regional Council
subsequently passed a by-law on September 9, 1987 approving the
amendr~ent. Rather than modifying the boundaries of the "f~1ajor Open
Space" as recommend by the Town, Amendment No. 173 modifies the
provisions in the Regional Official Plan relating to the Bond Head Rural
Cluster. The amendment specifies that infilling can occur on private
wells and waste disposal systems in Part Lot 27, B.F.C., Clarke
providing, among other conditions, that the local Council delineates the
area to which the amendment applies in the Bond Head Development Plan.
The zoning By-la4v as proposed by Staff rezones the entire eastside of
Pari< Street to a "Rural Cluster" zone. The east side of Park Street
contains two (2) residential lots in addition to the Staby property, and
Staff note a rezoning to Rural Cluster would permit a maximum of two (2)
additional residential lots. Staff have no difficulty with this rezoning
and the expansion of the Bond Head Rural Cluster, noting that it
recognizes the existing residential nature of the east side of Park
Street. As well, the affected residents on Park Street indicated no
objection to a possible rezoning to "Rural Cluster" at a meeting with
Staff on Play 11, 1987. A copy of this Report has also been forwarded to
the residents for their information.
Accordingly, it is recori~mended that the bond Head Development Plan, as
amended and attached to this Report as Attachment No. 2, be forwarded to

Council for approval. As well, it is recommended that the ar~ending
Zoning 6y-law attached to this report as Attachment No. 3, be forwarded
to Council for approval.

AMENDMENT N0.173 TO THE DURHAM REGIONAL OFFICIAL PLAN

PURPOSE: The purpose of this Amendment to the Durham Regional Official
Plan is to permit further minor development on individual wells
and waste disposal systems within the cluster known as Bond
Head.
LOCATION: Part of Lot 27, Broken Front Concession, former Township of
Clarke, now in the Town of Newcastle.
BASIS: The amendment is considered appropriate to recognize existing
rural non-farm residences and permit the development of some
additional non-farm residences on lands not to be serviced by
municipal water or sanitary sewerage which are adjacent to the
residential cluster of Bond Head.
ACTUAL The Durham Regional Official Plan is hereby amended by adding
AMENDMENT: Section 10.2.1.9 as follows:
"10.2.1.9 Having fulfi]led the provisions of 10.2.1.6, 10.2.1.7
and 10.2.1.8, further minor residential infilling, to
be serviced with private individual drilled wells and
_ waste disposal systems, may be permitted in the Bond
Head cluster on lands in Part of Lot 27, Broken Front
Concession, former Township of Clarke, now in the
Town of Newcastle, subject to the following
conditions:
a) The Council of the area municipality has
delineated the area to which this Amendment
appears in the Bond Head Development Plan;
_ b) the -private drilled well and the private waste
disposal systems comply with the standards of the
Ministry of the Environment as amended from time
to time and as administered by the Medical
Officer of Health or otherwise; and
c) appropriate requirements have been included in
the zoning by-law.
IMPLEMENTATION: The provisions set forth in the Durham Regional Official Plan,
as amended, regarding the implementation of the Plan shall apply
in regard to this Amendment.
INTERPRETATION: The provisions set forth in the Durham Regional Official Plan,
as amended, regarding the interpretation of the Pian shall apply
in regard to this Amendment.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
4JHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 7.3 "SPECIAL EXCEPTIONS - RURAL CLUSTER (RC) ZONE" of
By-law 84-63, as amended, is hereby further amended by adding thereto
the following new Subsection 7.3.7 as follows:
"7.3.7 RURAL CLUSTER (RC-7) ZONE
Notwithstanding Section 7.2, those lands zoned "RC-7" on the
Schedules to this By-law shall be subject to the following zone
reyulations:
a) Lot Frontage (minimum) 50 metres"
2. Schedule "5" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Agricultural Exception
(A-1)" to "Residential Cluster Exception (RC-7)" as shown on the
attached Schedule "X" hereto.
3. Schedule "X" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on, the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
