RECD ENDATIONS:
It is r•espectfu1ly recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-211-87 be received; and
2. THAT the application submitted by Ki ngsber•r•y Pr•oper•ti es r•equesti ng the removal of
the "(H) Holding" symbol from lands located within Part of Lot 35, Concession 2,
Darlington, be approved and that the attached by-law hereto be for•war•ded to Council
for• approval.
On November 14, 1986 the Planning Department received an application submitted by
I<ingsber•r•y Pr•oper•ties to rezone five (5) parcels of land in Part of Lot 35, Concession 2,
for•mer• Township of Dar•1 i ngton. As noted i n Staff Report PD-294-86, the pr•oper•ti es have
been acqui r•ed as a part of a 1 and acqui si ti on which Ki ngsber•r•y Pr•oper•ti es Limited and Fr•ab
Investments ar•e undertaking to develop in conjunction with plans 10M-779 and 10M-781. The
purpose of the rezoning would be to permit the development of those portions of the
subject lands for• low density residential usage on full municipal services.

Staff would note for the Committee's information that the applicant has
entered into the appropriate subdivision agreement to permit the development
of Phase II of Plan 10h9-781 being the subject lands for which the removal of
the (H) Holding symbol has been requested. Staff would note that the
Subdivision Agreement was registered on title on August 18, 1987.
In accordance with departmental procedures, the application was circulated
to obtain the comments from other departments and agencies as noted within
Staff Report PD-294-86. In conside ration of the application no objections
were received from the circulated agencies in respect of the proposal as
filed.
Staff would note that, of the original five (5) parcels as submitted
requesting the removal of the (i~) Holding symbol, the attached by-law would
represent the third parcel to be completed if deemed appropriate by
Comr~ittee and Council.
In consideration of the above items, Staff would have no objections to the
removal of the "(li) Holding" symbol for the parcel of land as so noted
within Staff's recommendations. Additionally it is noted that pursuant to
Section 35 of the Planning Act, a by-law amendment to removal the "(H)
Holding" symbol is not subject to the normal appeal period so afforded the
standard rezoning application and accordingly is deemed final and binding as
of Council's approval of same.
Staff have considered Council's resolution of July 27, 1987 with respect
to further development in Courtice. 6Je note that this is the second
phase of a development which was approved prior to the above-mentioned
resolution. In addition, this development will facilitate servicing of

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Cor•por•ation of the Town of Newcastle.
WHEREAS the Council of the Cor•por•ation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Cor•por•ation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Cor'por'ation of
the Town of Newcastle enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby fur'ther'
amended by changing the zone designation from "Holding - Urban
Residential Type One "((H)R1)" to "Urban Residential Type One (R1)"
Zone as shown on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 35 of the Planning Act.
