HomeMy WebLinkAbout2380A By-Law to stop up and close part of the original road allowance between lots 14 and 15 in the Broken Front Concession of the Township of Darlington and providing for the sale thereof to the abutting owners. WHEREAS the Council of the Corporation of the Township of Darlington deems it advisable to pass a by-law to close that part of the original road allowance between Lots 14 and 15 in the Broken Front Concession of the Township of Darlington, known as Martin Road and being that part thereof lying within the limits of the Canadian National Railway, more particularly described in Schedule "A" hereto. AND WHEREAS Notice of such by-law was published in The Canadian Statesman, a weekly newspaper published in the Town of Bowmanville and circulated in the Township of Darlington, in its issues dated February 7th, 14th, 21st and 28th, 1968. AND WHEREAS Notice of such by-law was further published by posting up for at least one month in six of the most public places in the immediate neighbourhood of each of the said parts of road allowances. AND WHEREAS no person or corporation will be deprived of the means of ingress and egress to and from his land or place of resi- deuce by the passing of this by-law. NOW THEREFORE the Council of the Corporation of the Town- ship of Darlington pursuant to the Municipal Act R.S.O. 1960 Chapter 249, Section 459 (1} (c} and (d} and Section 477 (1) HEREBY ENACTS as follows: 1. That the said part of the original Road Allowance between Lots 14 and 15 in the Broken Front Concession of the Township of Darlington, Known as Martin Road, more particularly described in Schedule `°A" hereto, be and-the same is hereby closed and stopped up. 2. That the said original Road Allowance hereby stopped up and closed shall be off erred for sale to the Canadian National Railway, the only abutting owner thereon, at the price of $1.00. .. 'i - 2 - 4. That upon payment of the said $1.00 purchase price by the said Canadian National Railway, the Reeve and Clerk are hereby authorized bpd directed to sign a conveyance of the said stopped up original Road Allowance in favour of the Owner and impress the Corporate Seal thereon. By-Law given its third reading and finally passed, this ~, ~ day of March, 1968. /~ %~% Reeve ~j h _~" -~-``'~f.~a~-fir..-1 -~ --- -- Clerk ~ ~~~ ~1 ~ SCH®ULE "A" ALL AND SINGULAR Ghat certain parcel or tract of land and premises situate, lying and being in the Township of Darlington, in the County of Durham' in the Province of Ontario, and being com osed of ail that part of the original Road Allowance between Lots Fourteen (14~ and Fifteen (1,"s) in the Broken Front Concession of the said Township of Darlington lying within the Canadian National Railway right-of- followse boundaries of the said parcel being more particularly described as s PF`"'ISING that the aforesaid Raad Allowance has a bearing of North 17 degrees 3T minutes West and relating all bearings herein thereto; COAOdFNCiNG at the point of intersection of the North-westerly limit of the Canadian National Railway right-of-way with the Easterly limit of the original Road Allowance between Lota 14 and 15 in the Broken Front Concession of the said Township of Darlington, said point being the South-Westerly angle of Block "B" according to Registered Plan Number 661 for the Township of Darlington which is distant Southerly in the Westerly limit~of Township Lot 14 twenty-five hundred and twenty-two and sixty-two one-hundredths feat (2522.62') more or less €rom the North-Westerly angle of Township Lot 14; THENCE South 17 degrees 31 minutes East along the Easterly limit of the said Road Allowance a distance of one hundred and ten and five one-hundredths feet {110.05') to the point of intersection with the South-Easterly limit of the Canadian National Railway right-af-way; ?HENCE South 47 degrees 4S minutes 30 seconds West along the last-mentioned limit a distanee of seventy-two and sixty-three one-hundredths feet (72.63') to the paint of intersection with the Westerly limit of said Road Allowance; THENCE North 17 degrees 31 minutes West along the Westerly limit of the original Road Allowance between Lots 14 and I5 in the Broken Front Concession of the said Township of Darlington, a distance of one hundred and ten and five one-hundredths feet (110.05') to the point of intersection with the North-westerly limit of the Canadian National Railway right-of-way; THENCE North 47 degrees 4B minutes 30 seconds East along the last-mentioned limit a distance of seventy-two and sixty-three one-hundredths feet (72.63') more or ~:ess to the POINT OF COPlAHdCEh1ENT.
