AND DEV 87-31 (SHEPHERD) r- RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-164-87 be received; and * 2. THAT the by-laws and schedules attached hereto be approved. 3ACKGROUND AND COMMENT: This report will deal with the removal of the "Holding (H)" symbol from the lands involved with each of the applications listed above. Each of the applications will be outlined in order. The format of one report was chosen because most of these applications have been previously approved, at least in principle, by Council. Section 3.9 of the Zoning By-law states: "Unless otherwise specified within the respective zone regulations, where the zone symbol shown on a Schedule to this By-law is preceded by the letter (H), the use of the lands shall be limited to existing residential uses and conservation, forestry and farm uses exclusive of livestock operations. ...2 ~Ch) REPORT NO.: PD-164-87 Page 2 The (H) Holding symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, the lands to be used have adequate access, prior uses of the land will not prevent the use of the land for the purposes intended by the By-law, that the lands and proposed uses will be adequately protected from any physical or man-made hazard or conditions associated with the lands, that agreements in respect of such matters and the associated financial requirements where required, have been executed with the Town of Newcastle and the Owner has satisfied all of the requirements of the Regional Municipality of Durham with respect to the provision of sewer and water services and Regional roads and entered into any necessary agreements in this regard." In each of the seven (7) cases, Staff has ensured that the provisions regarding the rernoval of the "H" symbol have been addressed. In the case of a Land Division application, the conditions attached to the approval will ensure that the requirements of the Town are met prior to the lot or lots being approved. With subdivisions, all of the conditions are outlined by the draft conditions of approval and are implemented through the subdivision agreement. The rezoning applications are circulated to technical agencies and Staff review the applications to ensure that any development which is proposed will not adversely impact upon future development in the area. On May 22, 1987, the Planning Department received an application from Mr. M. Foley, on behalf of Kingsberry Properties to remove the Holding symbol from lands in Part of Lot 35, Concession 2, Darlington. This was assigned File Number: DEV 87-46. These parcels were created by consent and, as a condition of this approval, the requirements of the Town of Newcastle had to be fulfilled. These lots were back lots to be developed in conjunction with lOM-781 (Remlark Holdings). All of the other conditions of the severance have been met; therefore, Staff are now in a position to recommend that the "(H) - Holding" symbol be removed. This development was shown on the draft approval for the subdivision to the west as lands for future development. All of the services were provided at the time the road for this subdivision was constructed. This proposed, for four (4) lots for single detached dwellings, conforms to the development plans which Staff have reviewed for this area. For the Committee's information, a copy of the Notice to the Owners has been attached to this * Report (see Attachment No. 1). ...3 h) ~~ C REPORT NO.: PD-164-87 Page 3 Five (5) owners of plans of subdivision, which were draft approved, have all recently submitted agreements for their respective sites. These have all arrived in such a short period of time due to the increase in levies which the Town has introduced. Staff are in the process of finalizing each of the agreements in question. Two (2) proposed Plans of Subdivision were submitted by Dr. King and Betty Jo King, one in 1984 and the other in 1985. These were assigned File Numbers: 18T-84029 and 18T-85032, respectively. In June of 1987 an application was filed by Halminen Homes, File Number: DEV 87-47, to have the "(H) - Holding" symbol removed from these lands. Council has forwarded, to the Region of Durham, draft conditions for approval (the Region has issued its draft conditions), and the applicant has just submitted subdivision agreeements for the subject lands. Staff are now in a position to recommend that the "(H)" symbol be lifted. All of the conditions requested as conditions of the Town's approval, have been fulfilled through the Agreement. For the Committee's information a copy of each of the Notices is attached ~ hereto (See Attachment Nos. 2 & 3). Each of the plans of subdi vi sion wil 1 have a separate by-law to recognize the limits of the draft approvals. Similarly, Foster Creek Developments submitted two proposed plans of subdivision in Newcastle Village. These were given File Numbers: 18T-84011 and 18T-85030. After revising the two plans, the applicant requested a rezoning from "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type Two (R2)" in January, 1987. Council approved the rezoning but left the "(H)" in place until all development agreements were in place. The applicant has provided the Town with agreements which have dealt with the conditions for approval which had been attached to each subdivision. These agreements are now being finalized and Staff are now in a position to recommend that the "H" symbol be removed from each of these proposed plans. ...4 ~(h) REPORT NO.: PD-164-87 Page 4 For the Committee's information, Attachments 4 & 5 detail the areas concerned for 18T-84011 and 18T-85030 respectively. Mr. V. Huttman, representing 677922 Ontario Limited filed a rezoning application in September, 1986. The lands subject to 18T-86058 were zoned for residential development and Council has approved the amendment to the Hamlet Plan to permit the subdivision to develop. Staff have the subdivision agreement and are working towards the finalization of the terms, and accordingly, have no objection to the removal of the "Holding" symbol. For the Committee's information a copy of the notice is attached hereto * (Attachment No. 6). The last application to be dealt with is a rezoning by Ms. Michelle Shepherd. This application (DEV 87-31) has been circulated to various technical agencies and Staff has reviewed the proposal. For the Committee's information, Attachment No. 7 illustrates the property location. The applicant wishes to demolish the existing dwelling and replace it with a larger home. In order to permit the construction, the "(H) - Holding" symbol has to be removed. At this time, the property has an existing access, municipal water and a private sewage disposal system. After discussions with the Regional Works Department it was clear that there was no objection to the proposal and there is no requirement for a servicing agreement. No agreement is required as there is not going to be an increase in the number of units on the site. The Regional Health Department also has no objection, although a permit for the septic system will have to be issued prior to the building permit. The last point of concern was regarding the proximity of the rear yard to the "Environmental Protection (EP)" zone. It appears that there will not be a problem since there is not to be a redefinition of the "EP" limits. This resolves the Ministry of Natural Resources concern. The Central Lake Ontario Conservation Authority will issue a permit for the construction and, after speaking with the Staff, there was not any apparent problem. Lastly, none of the Town Departments had any objections to the proposal. ...5 Ch) REPURT NU .: PD-164-87 Page 5 Staff have proposed removal of the "(H) Holding" symbol on enough of the property to permit the applicant to locate the new home in the area proposed by the application, with some room to spare in case any problems are encountered during construction. There does not appear to be any adverse impact upon the surrounding lands. There is no Neighbourhood Development Plan for this specific location, but Staff have reviewed the area and do not believe that a home in the proposed location will adversely impact upon future development in the area. Staff have no objection to any of the applications and would respectfully recommend that the attached by-laws be forwarded to Council for approval. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One "((H)Rl)" to "Urban Residential Type Une (R1)" as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One "((H)R1)" to "Urban Residential Type One (Rl)" as shown on the attached Schedule "X" hereto. 2.
