RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-190-87 be received; and
'L. THAT the rezoning application submitted by Mr. Ron Sucee requesting the removal of
the "(H) Ilolding" symbol from the "Holding - Residential Hamlet ((H)RH)" zone of
said lands, located within Part of Lot 20, Concession 10, Darlington, mare
particularly described as Part 2 on Plan 10R-549, be approved.
On April 21, 1987 athe Planning Department received an application from Mr. R. Sucee to
remove the (H) Holding symbol from lands in Part of Lot 20, Concession 10, Darlington.
Section 3.9 within Zoning By-law 84-63, as amended, requires that, prior to the removal of
the Holding symbol, Council shall be satisfied that the uses to be permitted will be
adequately serviced, the lands to be used have adequate access, prior uses of the land
will not prevent the use of the lands for the purposes intended by the By-law, the
proposed uses will be adequately protected from any physical or man-made hazard, and that
the necessary agreements in respect of such matters and the associated financial
requirements, where required, have been completed.

In accordance with departmental procedures, the application was circulated
to obtain the comments from other departments and agencies. In summary, the
following agencies offered no objections:
- Ministry of Agriculture and Food
- Kawartha Conservation Authority
- Durham Regional Health Unit
- I~linistry of Natural Resources
- Town of Newcastle Fire Department
- Ontario Hydro
- Town of Newcastle Building Department
- Town of Newcastle Community Services
The Town of Newcastle Works Department, in responding, noted the following:
"We have reviewed the application for rezoning as noted above, and submit
the following comments:
1. That a 5.029m road widening be dedicated to the Town along the frontage
of the subject property.
2. That the Owner pay the cost of constructing Darlington Street from
north lines RP # M-748 northerly approximately 61m; satisfactory to the
Director of Public Works.
3. That the Owner will pay the costs of street lighting; satisfactory to
the Director of Public Works.
4. That all works are completed in accordance with the Town of Newcastle's
Design Criteria and Standard drawings.
5. That the Owner meet all the requirements of the Public Works
Department, financial or otherwise."
It i s Staff's understanding i n discussing the above comments with the Town
of Newcastle Works Department that financial arrangements have been
acknowledged and confirmed with the applicant for the extension of
Darlington Street and provision of an appropriate road widening.

In consideration of same, Staff would have no objections to the removal of
the (H) Holding symbol as it effects the subject lands and the forwarding of
* the attached by-law to Council for its approval.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "12" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Holding - Residential
Hamlet - ((H)RH)" to "Residential Hamlet (RH)" as shown on the
attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 35 of the Planning Act.
