RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-106-87 be received; and
'L. THAT the application filed by Mr. E. Vanhaverbeke on behalf of Foster Creek
Developments Limited to rezone the subject lands be forwarded to Council for
approval.
BACKGROUND AND COMMENT:
On January 21, 1987 the Planning Department received an application filed by Mr. E.
Vanhaverbeke on behalf of Foster Creek Developments Ltd. This application is to rezone a
parcel of land from "Holding - Urban Residential Type One ((H)R1)" to "Holding - Urban
Residential Type Two ((H)R2)" zone. The applicant also requested that the "Holding (H)"
symbol be removed. It is not in keeping with policy to do this prior to the Subdivision
Agreement being entered into and the Plan of Subdivision being registered.

The subject lands are designated as "Residential" by the Newcastle Of ficial
Plan. There does not appear to be any problems with respect to the Plan.
This application has the effect of reducing the proposed density by ten (10)
units.
The subject lands are currently zoned as "((H)R1)". This type of zone
permits development of semi-detached units, which the original subdivision
proposed, on lots with 18 metres of frontage. The proposed amendment would
permit only single detached dwellings on lots with a mini mum frontage of 12
metres. The developer has decided that the market is more oriented towards
single detached dwellings and is thus requesting the change in zoning.
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the
subject lands. Staff would note that no objections to the proposal were
received at the writing of thi s Report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtai n comments from other departments and agenci es as noted within Staff
Report PU-44-87. Staff would note the following departments/agencies, in
providing comments, offered no objections to the application as filed:
- Newcastle Public Works Department
- Newcastle Community Services Department
- Newcastle Fire Department
- Newcastle Building Department
- Newcastle Hydro Electric Commission
- Ganaraska Region Conservation Authority
- Regional Health Department
- Ministry of Natural Resources
Durham Regional Planning Department
"It is our understanding that the purpose of the proposed amendment is to
accommodate the owner's intention to re-design proposed plan of subdivision
18T-85030 for single detached lots.

Although we do not Nave a concern with the change anticipated in dwelling
unit type, we would note that the Town of Newcastle Official Plan stipulates
that residential density in the former Village of Newcastle should not
exceed 14 units per net residential hectare. We would suggest that the Town
closely examine this proposed rezoning, together with the redesign of plan
18T-85030 which is currently under circulation, to ensure that this
development will be in keeping with the Plan's density standards."
Durham Regional Works Department
"We have reviewed the above-noted rezoning application and wish to provide
comments as follows:
Full municipal services are available to the subject land through the
abutting watermain on Edward Street and the existing sanitary sewer on the
nearby park land, east of Hart Court. The design of the proposed services
to the subject land as well as the adj acent lands owned by Foster Creek
Developments Limited has been submitted to the Works Department for review.
In addition, the Regional Works Department's concerns, financial and
otherwise, are anticipated to be covered by an appropriate subdivision
agreement on the basis of conditions imposed to the related draft plan
18T-85030.
The Works Department would have no objection to the further processing of
this rezoning application to permit development of residential lots within
minimum 12m frontage."
Staff have reviewed the issue of density. The result of the modification is
a reduction in unit count so there does not appear to be a problem.
After reviewing the proposal there does not seem to be any problems
regarding the rezoning; therefore, Staff respectfully recommend that the
* attached by-law be forwarded to Council for approval.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend ey-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporatio n of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "5" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Holding - Urban
Residential Type One ((H)R1)" to "Holding - Urban Residential Type
Two ((H)R2)" Zone as shown on the attached Schedule "X" hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 35 of the Planning Act.
