OF DARLINGTON OUR FILE: DEV 87-12 RECOMMIENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-116-87 be received; and 2. THAT the application submitted by Mr. A. Kemperle on behal f of Halcorp Hol di ngs Limited requesting the removal of the "(H)-Holding" symbol from the lands located within Part of Lot 30, Concession 2, former Township of Darlington be appr oved and that the by-law attached hereto be forwarded to Council at such time that the Town has received a copy of the registered Site Plan Agreement and written confirmation that the Region of Durham servicing requirements have been satisfied. BACKGROUND AND COMMENT: On February 17, 1987 the Planning Department received an application submitted by Mr. A. Kemperle, on behal f of Halcorp Holdings Limited requesti ng the removal of the "(H) Holding" symbol from the "(H)R4" zone of the subject lands to permit the development of a One Hundred and Eighty (180) unit apartment complex comprising of ten (10) residential buildings. It is Staff's understanding that an application will be made by the applicant for the registration of the said lands under the provisions of the Condominium Act. ...2 ~~.~) REPORT NO.: PD-116-87 Page 2 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies as noted within Staff Report PD-67-87. In consideration of the application, no objections were received, however, the Region of Durham Planning Department noted that in consideration of the provisions of Section 16.6.4(b)iii) within the Regional Official Plan, the owner is to satisfy the requirements of the Region with respect to the provision of sewer and water services and Regional roads and any necessary agreements before said (H) Holding symbol is to be removed. Staff has been advised by Regional Staff that an Agreement has not been finalized as of the preparation of this report, although, negotiation in respect of same are on going. To that end, Staff have incorporated an appropriate provision in the Site Plan Agreement in respect of the Region's concerns requiring completion of same prior to the issuance of a building permit. A copy of the agreement has been forwarded to the Region for their information. In view of the applicant's interest in applying for condominium approval, Staff have included within the Site Plan Agreement, additional provisions consistent with Town Policies i.e. dedication of valleylands and provisions pursuant to the requirements of the Planning Act, and the Condominium Act i.e. the payment of cash-in-lieu of parkland. Staff note that the applicant has not agreed to the dedication of valleylands and wi11 be making a submission to Council relative to same. Staff cannot concur with the applicant's request that he be exempted from this recently adopted policy. Accordingly, the proposed agreement requires this dedication but affords the applicant an opprtunity to request Council's consideration of this requirement prior to condominium approval. ...3 ~c~) REPORT NO.: PD-116-87 Page 3 In consideration of the above, Staff would have no objections to the removal of the "(H) Holding" symbol as so noted within's Staff's recommendations. Additionally, it is noted that, pursuant to Section 35 of the Planning Act, a by-1 aw amendment to remove the "(H) Holding" symbol i s not subject to the normal appeal period so afforded the standard rezoning application and accordingly, is deemed final and binding as of Council's approval. FaClaO ~C~~ t THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 87- being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NUW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type Four ((H)R4)" to "Urban Residential Type One (R4)" Zone as shown on the attached Schedule "X" hereto. 2. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
