RECOPiP1ENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PO-121-87 be received; and
?_. THAT the application filed by Mr. Green to rezone apart of Lot 9, Concession 2, in
the forcer Town of Bowmanville, known as 25 Bradshaw Street, to permit the creation
of one (1) additional residential lot be approved in principle and be forwarded to
Council once the Regional Health Services Department has confirmed that it is
feasible to place a septic system on the site.
BACKGROUND and COMMENT;
The Planning;Department received an application 'on February 13, 1:987:, submitted by Mr.
Charles Green, The application was to approve a rezoning which would, permit the-lot to be
severed, ;thereby ,creating one (1) additional residential lot. The site currently has
municipal water available but there is no municipal sewer, nor are there plans to provide
such service to this street.
Staff circulated the application on February 17, 1987, at the time of the writing of this

Report there had been no written comments submitted by the Regional Planning
Department. Verbal comments were solicited and Staff was given the comments
from the Regional Works Department (see above).
The subject lands are designated as "Residential" by the Bowmanville Major
Urban Area Plan. Residential dwelling shall be the predominant use
permitted on lands so designated.
The subject site is currently zoned as "Agricultural (A)" by the
Comprehensive Zoning By-law of the Town of Newcastle, being By-law 84-63,
` and amended.
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 198?_ and the requirements of the Planning Act, the
appropriate signage acknowledging the applcat ion was installed on the
subject lands. Staff would note that no objections to the proposal were
received at the writing of this Report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted within Staff
!. Report PD-167-86. Staff would note the following departments/agencies, in
providing comments, offered no objections to the application as filed:
Newcastle Fire Department
Newcastle Building Department
Newcastle Hydro-Electric
Central Lake Ontario Conservation Authority
Ministry of Agriculture and Food
Ministry of Natural Resouces
Both of Newcastle Public Works and Community Services had no objection to
the principle, but had conditions which would be imposed at the time of the
severance. There will be a need for road widenings, road upgrading and a
cash-in-lieu of parkland dedication charge.

In reviewing this application Staff was concerned with the level of
development which may be encouraged prior to the area being provided with
full municipal services. Examination of the ownership pattern along
Bradshaw revealed. that 1 i the more development by means of severance was
likely. Also each such application would require rezoning.
At this time there is no development plan for this area. It does not seem
that the creation of one lot, in an infilling situation, would hamper the
future development of this area of Bowmanville. The lot is not wide enough
for a road allowance,. nor is the lot .deep enough to impact upon development
to he east.

Written comment has not .been received from Regional .Works but Staff assume
that the standard condition relating to the need fora servicing .agreement
will be imposed ,at the time the land is severed. The new lot will be
required to .use the municipal water-which is existing on ,Bradshaw Street.
Prior to issuance of a Building Permit the Zoning By-law requires Ghat the
servicing agreement be executed.
The Health Department is now reviewing the lot to determine whether it can
support a septic system.. The proposed lot would have approximately 15.68
metres of frontage-and. a lot area of approximately 780 square metres. This
is large enough to ;meet the requirements of the proposed "Urban Residential
Type One (Rl)" zone. Provided the Health Department approves a septic
system, Staff has no objection to the approval of the application, and
* recommends that the By-law attached hereto be approved in principle by
General Purpose and Administration Committee and forwarded to Council for
approval should the Health Department provide a positive response.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
I. Schedule "3" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Agricultural (A)" to
"Urban Residential Type One (R1)" as shown on the attached Schedule
"X" hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.

1987.
