RECOPM+IENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-139-87 be received; and
2. THAT the application for rezoning submitted by Mr. R. Mitchell, to permit the
creation of one (1) additional urban residential lot, be approved.
BACKGROUND AND COMMENT:
Un Nlarch 10, 1987, the Planning Department received an application submitted by Mr.
Mitchell to rezone a 0.13 hectare parcel of land in Part of Lot 35, Concession 3, former
Township of Darlington. The purpose of the rezoning is to permit the creation of one (1)
additional urban residential lot.
The subject lands are designated as "Residential" in both the Durham Regional Official
Plan and the Newcastle Official Plan. The proposed residential uses are permitted by the
Official Plans.

Staff have reviewed this proposal in light of the proposed Neighbourhood
Plan for this area, and the concept does not appear to have any impact
upon the development in this area. The lots appear to back upon the
proposed Neighbourhood Park and the creation of an additional dwelling
will not have any impact upon the concept.
Staff would note for the Committee's information that pursuant to
Council's resolution of July 26, 1982 and the requirements of the
Planning Act, the appropriate signage acknowledging the application was
installed on the subject lands. Staff would note that no objections to
the proposal were received at the writing of this Report with respect to
the amendment requested.
Tn accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies as
noted within Staff Report PD-97-87. Staff would note the following
departments/agencies, in providing comments, offered no objections to the
application as filed:
Newcastle Fire Department
- Newcastle Building Department
- Central Lake Ontario Conservation Authority
- Regional Works Department
- Regional Health Unit
- Ministry of Agriculture and Food
- Ministry of Natural Resources
- Ontario Hydro
The applicant had a dwelling on the property, but this was destroyed by
fire and it is no longer useable. This application, if granted, will
peronit the severance of the land and the development of the parcel as two
(2) urban residential lots. Each of these lots will conform to the lot
area and frontage requirements of the "Urban Residential Type One (R1)"
zone of the By-law. Ttie By-law requires that full municipal services be
provided, or a Servicing Agreement be entered into. The Owner has
provided Staff with the proof that the hook-ups were installed when the
contractor was putting the services up Varcoes Road. This was confirmed

in a memo from the Regional Construction Inspector (dated April 14,
1987).
At the time the applicant applied, Staff noted that there would be a
number of conditions attached to the creation of the additional lot.
These conditions will include lot development fees, cash-in-lieu of
parkland dedication, and will also include a charge for road
reconstruction as outlined in the subdivision agreement between the Town
and Schleiss and Holland. All of these will be attached as conditions to
the Land Division application.
Staff have no objection to this rezoning as this is an area designated
for residential growth and the applicant is providing a lot which
conforms to the requirements of the By-law; therefore Staff is
recommending approval of the attached by-law.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Agricultural (A)" to
"Urban Residential Type One (R1 )" as shown on the attached Schedule
"X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
