OF DARLINGTON OUR FILE: DEV 87-10 CLERK'S FILE: 60.35.354 RECOt~ENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-140-87 be received; and 2. THAT the application for rezoning submitted by Nir. & Mrs. Andy Jarvis, to permit the creation of one (1) additional urban residential lot, be approved. BACKGROUND AND COMMENT: The subject application was received by the Planning Department on February 16, 1987 and the plans were submitted in mid March. The application was filed in order to permit the creation of one (1) additional urban residential lot. The subject lands are designated as "Residential" in both the Durham Regional Uffici al Plan and the Newcastle Official Plan. The proposed residential uses are permitted by the Uffici al Plans. ...2 --~~.. ~~~~~ REPORT NU.: PD-140-87 Page 2 Staff have reviewed this proposal in light of the proposed Neighbourhood Plan for this area, and the concept does not appear to adversely impact upon the Plan. These two lots will probably back onto the proposed Neighbourhood Park. Staff would note for the Committee's information that pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. Staff would note that no objections to the proposal were received at the writing of this Report with respect to the amendment requested. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies as noted witY~in Staff Report PD-92-87. Staff would note the following departments/agencies, in providing comments, offered no objections to the application as filed: - Newcastle Fire Department - Central Lake Ontario Conservation Authority - Regional Works Department - Regional Health Unit - Ministry of Agriculture and Food - Ministry of Natural Resources - Untario Hydro The applicants have a parcel of land which is 30.48 metres in width. The minimum width for an "Urban Residential Type Two (R2)" lot is 12 metres. The lot also has more than sufficient area to create two (2) lots of, at least, 37Um2. The Zoning By-law also stipulates that the sites should have municipal services or enter into a Servicing Agreement. The Owner has verbally informed Staff that the sanitary sewer and water hook-ups were put into place when the road construction was done. ...3 1 i ~ REPORT NU.: PD-140-87 Page 3 The intent is to see this area develop for Low Density Residential uses. This proposal conforms to the intent of the plan. At the time the applicant applied, Staff noted that there would be a number of conditions attached to the creation of the additional lot. These conditions will include lot development fees, cash-in-lieu of parkland dedication, and will also include a charge for road reconstruction as outlined in the subdivision agreement between the Town and Schleiss and Holland. All of these will be attached as conditions to the Land Division application. The use of the "R2" zone will permit the creation of a new lot which conforms 'to the By-law (for lot frontage and area) while maintaining a lot which conforms to the lot frontage and area. The existing dwelling will also conform to the minimum sideyard requirements of the appropriate zone. Staff have no objection to the principle of the rezoning and do not foresee any difficulties in the proposed reduction in frontage. The area is intended for Low Density Residential uses and the proposal conforms to the intent of the plan; therefore, Staff recommends that the By-law * attached hereto be forwarded to Council for approval. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NUW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Urban Residential Type Two (R2)" as shown on the attached Schedule "X" hereto. `l. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
