THAT Report PD-141-87 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of April 30, 1987. This list includes the file number, applicants name, site location, type of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments on the applications and the Committee of Adjustment's decision. Murdoch Gordon Barrie Bernhard Herring Jean Payne Carrot Clemens APPLICATIONS: A 25/87 - Carnovale Construction Ltd., Lot 35, Conc. 2, Darlington Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the construction of a single family dwelling having an exterior side yard of 5.57 m, instead of the required 6 m side yard. Mr. Kent Young appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Barrie, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law and wuold not appear to have a detrimental effect on the surrounding properites, this variance is con- sidered minor in nature and permission is GRANTED to continue the construction of a single family dwelling with an exterior side yard of 5.57 m." "CARRIED" ,L-L~. <~ Committee of Adjustment Meeting ,. April 30, 198:7..:. A 26/87 - Beppy Sluymers, Lot ll, Concession 3, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a single family dwelling leaving a rear yard of 6 m, instead of the required 15 m rear yard. Mr. Sluymers appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mrs. Payne, "THAT as the proposed variance would appear to comply with the intent of the Official Plan and the Zoning By- law and as the shortage in the rear yard would not have a detrimental effect on the area, permission is GRANTED to construct the single family dwelling leaving a rear yard of 6 m, instead of the required 15 m rear yard:" "CARRIED" A 27/87 - Halminen Homes Limited, Lot 9, Concession 1, Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a single family dwelling leaving a rear yard of 3.35 m, instead of the required 7.5 m rear yard. Andy Kemperle appeared in support of this application. Mr. Nimigon appeared in opposition to this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Rehder, "THAT as the proposed variance would appear :to conform with the intent of the Official Plan and Zoning By-law and as the shortage in rear yard would not have a detrimental. effect on the area, permission is GRANTED to construct a single family dwelling having a rear yard of 3.35 m, instead of the required 7.5 m rear yard." Tie vote, motion lost, therefore application denied. ~- <J Committee of Adjustment, April 30, 1987..... A 28/87 - Mary-Pike, Lot 18, Concession 2, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot with a frontage of 94.07 ft. (28 m), instead of the required 30 m lot frontage. Mary Pike appeared in support of this application. Mr. Alldread and Mr. Gagnon appeared in opposition to this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Herring, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law, permission is GRANTED to create a lot with a frontage of 28 m, instead of the required 30 m frontage on condition that the requirements of the Regional Health Department be addressed and that Ontario Hydro submit verification to the Town that the hydro service is returned to one (1) meter service." - "CARRIED" A 29/87 - Edward & Grace Coatham, Lot 26, Conc. 4, Clarke. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 960 sq. ft. accessory building, which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr. Coatham appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Murdoch, "THAT as the proposed variance would appear to co~ply with the intent of the Official Plan and the Zoning By-law, as the proposed building would not appear to have a detrimental effect on this rural area, and as the variance is considered to be minor in nature, permission is GRANTED to construct a 960 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the total floor area of the main builddng." "CARRIED" ,~ (~~ Committee of Adjustment Meeting, April 30, 1987.... A 30/87 - Lynn & Angela Helpard, Lot 1, Conc, S,.Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 1092 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr. Helpard appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Herring, seconded by Mr. Murdoch, "THAT as the requested variance would not appear to have an adverse effect on the surrounding properties and would not appear to offend the intent of the Official Plan or Zoning By-law and as there is limited useable basement space in the existing house the additional storage space is necessary, therefore the variance is considered minor in nature and per- mission is GRANTED to construct a 1092 sq. ft. accessory building." "CARRIED" A 31/87 - John T. Hogarth, Lot 11, Conc. 1, Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 480 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr. Hogarth appeared in support of this application. No other person appeared in support of or in opposition to this applccation. Moved by Mr. Barrie, seconded by Mr. Reicheld, "THAT as the requested variance would not appear to have a detrimental effect on the surrounding neigh- bourhood and would not appear to offend the intent of the Official Plan or Zoning By-law, therefore the variance is considered minor in nature and permission is GRANTED to construct a 480 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area." "CARRIED" ~ ~~~ Committee'of Adjustment Meeting, April 30, 1987.::.. A 32/87 - John McGuey, Lot 18, Concession 1, Clarke.... Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 743 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr. McGuey appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mrs. Payne, "THAT as the requested varinace does not appear to offend the intent of the Official Plan or Zoning By- law and appears to be minor in nature and would not have a detrimental effect on the surrounding pro- perties, permission is GRANTED to construct a 743 sq. ft. accessory building which is in excess of 40% of the main building total floor area." "CARRIED" OTHER BUSINESS: Moved by Mr. Barrie, seconded by Mr. Herring, "THAT the minutes of the last meeting be approved as circulated."
